Clients regularly ask if discretionary leave (10 years route to settlement) can be switched to a 5 years route to settlement category.

Got a client's leave on 10 years route changed to a 5 years route to settlement, saving the client 5 years, at least 2 additional applications, where only the Government fees would have been atleast over £5,250 plus lawyers fee.

The client will not even have to wait 1 additional year for applying for nationality upon completion of 5 years, whereas on the 10 years route, the client would have had to wait another additional year before they could apply for naturalisation.

For this client, they were without leave and had Home Office raiding their accommodation. Not only did we got the client leave to remain on the basis of distant relationship (not living together), we have now switched that initial leave on 10 years route to a much short route of 5 years route to settlement.

A total saving of atleast 6 years and a minimum of £5,250.

Applied by premium service and got the decision within 1 day.

FO v SSHD - This client was refused entry at airport, detained and removed from the United Kingdom. Her mother sought advice on how she can bring her daughter to visit the United Kingdom. She was previously advised by another lawyer that the client might be detained again if she travels.

Following consultation, I advised that not only will we get her entry to the UK but we will get her British nationality, directly.

Very pleased to share that yesterday the Home Office granted the client's nationality application, based on our submissions in respect of her stay in UK in the 1980s and 1990s.

HB v SSHD - Entry Clearance Manager withdraws refusal.

Following our pre-action protocol the ECM has withdrawn the refusal and agreed to reconsider.

However, we have written back to inform them that they must make a decision in 6 weeks, instead of their proposed time limit of 'at least 3 months'.

It is concerning, how initial decision (when all the documents are considered) can be made in a month or so, but reconsideration should take 'at least 3 months', without there being any change of circumstances.

We have further argued that it is an abuse of process because previously they have lost the judicial review and as per Court Order agreed to make a fresh decision in 3 months. The 3 months decision had the same factual errors as before.

It is our position that our client should not be penalised for Entry Clearance Officer's incompetence and their lack of training to understand basic bank statements.

Home Office grant further leave to remain as spouse for our client who had forgotten to extend her visa in-time and had overstayed by 87 days. Home Office granted the leave as spouse after accepting our submissions on exceptional circumstances.

Not only the client was granted a leave despite being an overstayer, she will continue to be on a 5 year route to settlement and this gap cannot impact her settlement application following Court of Appeal's guidance in Hoque & others v SSHD [2020] EWCA Civ 1357.

YW v SSHD - Home Office agree to pay damages for not issuing my client's BRP card on time. They kept on delaying the issuance of BRP for months, despite the client and his University constantly chasing them. Once we were instructed and issued proceedings against delay, the Home Office swiftly issued the BRP card before AOS was due. Now they have also offered to pay compensation to the client for their delay.

They also agree to pay our legal costs of the proposed proceedings!

BK v SSHD - Bail Granted!

The Tribunal grants bail to my client, after he completed his collective sentence of over 18 years including multiples serious offences, subject to providing a s10 address.

Not the best person to be representing but continued detention could not be legally justified. I hope he complies with the requirements imposed.
