Many couples live together for years without ever marrying. But when those relationships end, the law treats them very differently from married couples. There is no such thing as “common law marriage” in England and Wales. If your name isn’t on the deeds, or if you’ve made contributions to a property you don’t legally own, you may need to look at TOLATA — the Trusts of Land and Appointment of Trustees Act 1996. In my latest article, I explain what TOLATA is, how the courts deal with property disputes for unmarried couples, and why mediation can often provide a more constructive way forward than court.

Why Should Children Suffer?

As a family mediator, it’s deeply frustrating to see how, despite their best intentions, parents caught up in their own pain and conflict forget the needs of their children. Most parents are loving and want the very best for their kids, but during separation or divorce, the focus can shift. Too often, the children’s needs and rights are unintentionally pushed aside.

It’s heartbreaking to watch. I understand the overwhelming grief and challenges that come with separation, but we must ask ourselves – why should children be denied the love, care, and attention of both parents? They deserve to feel safe and loved, even through the toughest times.

Family mediation isn’t just about resolving adult conflicts. It’s about making sure children continue to thrive and know that they are still the priority, even when everything else is changing.
