As of today, the UK's new no-fault divorce law means that divorcing couples no longer have to point the finger of blame in order to achieve a divorce.

Under the previous rules, one spouse would have to prove that the other had either committed adultery, exhibited "unreasonable behaviour" or had deserted the marriage, otherwise the couple would have to live apart for two years before a divorce could be granted, or five years if one couple objected to the divorce.

Experts predict that there will be a large influx of divorces in the coming weeks by couples who were waiting for the legal reform.

There is also the opposing side to this, which is that couples who were previously hesitant to marry due to the onerous process required to divorce are now feeling more confident to 'tie the knot 'as they have an easier route out if the relationship sours.

I would encourage cohabiting couples to now consider the option to marry as it offers more protection to both parties, especially if there are children in the family.

Divorce doesn't have to be a war.

For most people, divorce is stressful and worry about the future is made worse by disputes with the other party involved.

Many couples are not aware of the options open to them; a range of alternative dispute resolution processes exist and using them often means that a couple can avoid court entirely.

What financial orders can a court make on divorce? 
 
If you ask the court to make a financial award in a divorce case, it has a number of options open to it. In reaching a decision, it will try to ensure that the financial needs of both parties are met. 

If there are children involved, then the court will always prioritise their needs. Financial orders deal with capital and property, maintenance and pensions. The court will put together a combination that it feels deals fairly with the situation. While the starting point is a 50:50 split, where one party is in a financially weaker position, for example, because they have given up their career to care for children, then they may receive a larger share of the available assets.
