The Family Procedure Rules have been updated today to promote the resolution of private family law proceedings outside of court.

The new rules encourage consideration of all forms of non-court dispute resolution (NCDR) - such as arbitration, third-party evaluation and collaborative divorce - and not just mediation.

Divorcing couples also now have to openly set out their views on NCDR prior to a hearing.

The changes have been introduced to help to make court a last resort without creating any barriers for individuals who do need to access the courts, such as domestic abuse victims.

According to , 1 in 5 women in the UK has experienced economic abuse by a current or former partner.

Economic abuse may include controlling income, spending, bank accounts and bills and even basic resources such as food, clothing, transport and technology.

Research by has found that the divorce gap between women and men often equates in huge financial disparity following divorce.

Women see their household income fall by an estimated 41% in the year after divorce, compared to 21% of men.

This disparity between men and women is caused by a number of factors, but mainly the fact that the main breadwinner in 70% of families is male. This presents a challenge as couples separate their finances and fund two separate households.

The fact that women are more likely to waive their rights to their partner's pension upon separation is another key factor. Many women are signing away their rights to this key financial asset.

If you're a co-habiting couple in England or Wales, did you know you have no legal rights if you separate? Without a cohabitation agreement, one of you could potentially be left with nothing.

A co-habitation agreement (also called a 'living together agreement'), is similar to a pre-nup for married couples. The agreement sets out how you and your partner will manage your finances - e.g. how you will share your mortgage or rent and bills - and how assets will be dealt with should you separate.

Co-habitation agreements aren't just for couples in a relationship - they can also be drawn up for friends or relations buying a property together. They can also be drawn up at any time.

🔹Family Mediation Week is held in January each year to raise awareness of family mediation and its benefits for separating families. This year it runs from 22nd - 26th January.

🔸What happens during Family Mediation Week?
🔹Events and talks are held across the country to raise awareness around mediation as a tool in separation and divorce.

🔸How can family mediation help me?
🔹If you are considering or starting divorce proceedings, mediation is a means of reaching a settlement through discussion, avoiding court proceedings. It is usually a less stressful, quicker and cheaper way of finding a resolution between both parties.

The first working Monday of the year is commonly known as 'Divorce Day' - the day that divorce lawyers receive the highest volume of new divorce enquiries.

Although there are differing opinions over whether this is actually the case, it is true that January does usually see a greater volume of divorce enquiries.

It is thought that this spike in divorce enquiries occurs because a couple’s problems are often exacerbated over the Christmas period. Spending more time together – often with the added pressure of extended family members being present – combined with financial worries can bring longer term relationship problems to a head.

January is also a time for new beginnings and can often bring about a desire for change and improvement.
