There are two types of LPAs:

- Property and Financial Affairs LPAs cover money, property and financial assets. Attorneys will be allowed to manage your bank accounts, pay your bills, sell any assets (including property), and collect benefits and pensions

- Health and Welfare LPAs cover personal decisions, such as your care, daily routine and any medical treatment. It can include decisions on what you wear, where you live and what you eat.

If you name an attorney in one type of LPA, it doesn’t give them authority to make decisions on the other type of LPA.

For that reason, we strongly recommend you having both types and keeping them up to date as life events happen, such as getting married or divorced.

An LPA is a proactive measure, not a transfer of ownership. As long as you have the mental capacity to make your own decisions, you are still in charge.

LPAs will usually only come into play if you lack mental capacity to make decisions and manage your own affairs. This could be due to an unexpected accident or illness, such as a stroke.

Legally, an attorney should act in your best interests and will need to gain permission to manage your affairs for you while you still have capacity to manage them yourself, if that’s what you wish.

Where possible, the attorney must encourage you to make your own decisions.

An LPA can be revoked at any time if you have the mental capacity to do so.

Although we advise our clients to draw up or update a Will and LPAs at the same time for ease and peace of mind, they serve entirely different purposes.

A Will is for when you die, but an LPA is for when you are alive but unable to make financial and health decisions for yourself.

is a good reminder to get an LPA drawn up if you don't already have one, or make sure your existing one is up to date and valid.

Even if your finances are all tied jointly to your spouse or partner, you will still need to state in an LPA that you wish for them to be your attorney and act on your behalf when paying bills and making financial decisions.

If you wait until you begin to lose mental capacity to choose who acts for you, it may be too late, as you need to have capacity when you create and sign the document.

You need to demonstrate that you understand and can remember what an LPA is, weigh up information, communicate the decisions you are delegating, and understand the consequences of those decisions.

If you lack capacity, you can’t set up an LPA. Yesterday’s myth outlined the consequences of losing capacity without a valid LPA in place, so take a look at that.

If you lose mental capacity without an LPA in place, a family member will need to apply to the Court of Protection to become a deputy. Your finances may be frozen, and decisions about your health may be made by doctors and social workers, rather than your family.

Going through court can be a long, stressful and costly process when emotions are already running high. Also, the court may appoint an individual you would not have chosen to manage your affairs and make decisions for you.

All of the above can be avoided with a valid LPA in place. Help us raise awareness about the importance of LPAs this .
