An in-country application (i.e. one from inside the UK) can be made if the applicant has valid permission to stay in the UK in any immigration category other than:

• As a visitor.
• As a short term student.
• As a parent of a child student.
• As a seasonal worker.
• As a domestic worker in a private household.
• Because they were given permission to stay outside the Immigration Rules, on compassionate grounds.

To be absolutely clear, if any of the above apply, the applicant would need to leave the UK and apply from overseas.

The application process varies depending on whether or not the applicant is:

• Applying from overseas.

Once the employer has identified a person who needs to be sponsored to fulfil a certain role, they need to enter information about the individual and the role onto an online form. The form is only accessible via the Sponsor Management System, a Home Office platform used by organisations with a sponsor licence.

If the worker will be applying for their visa from overseas, that information on the form is submitted to the Home Office. So long as the Home Office is satisfied that the work is genuine, the Home Office will grant a ‘Defined Certificate of Sponsorship’. The sponsor can then assign this to the individual.

If the worker will be applying from inside the UK, the sponsor can bypass the Home Office and assign the certificate of sponsorship directly providing they have a Certificate of Sponsorship available on their account. These are known as ‘Undefined Certificates of Sponsorship’.

Once the certificate of sponsorship has been assigned, a unique reference number is generated. This number must be given to the worker who must then input it onto their visa application form.

Only employers that have applied for a sponsor licence and appear on the Register of Sponsor Licence Holders can assign a Certificate of Sponsorship. E-visas – If you are granted status or permission to stay in the UK and do not have a valid passport, you will have a UKVI account created automatically by the Home Office and you will be notified of how to access your account. This gives you an online record of your immigration status and is known as an ‘e-visa’.

Once you access your UKVI account, you will be able to access the details of your e-visa online, for example your type of permission to stay, when it expires and your conditions of stay. You will also be able to update your personal details and register your passport if applicable, in your UKVI account so that you can easily travel to and from the UK.

If you were previously issued a biometric residence permit, you should keep your expired biometric residence permit card as it may help with future applications to stay in the UK. You may also want to keep it for your personal records.

Grant of other leave to remain – If you are not accepted as needing international protection but it is considered that there are reasons for allowing you to stay on a temporary basis, you will be granted limited permission to stay. It is for this reason that it is most important that you detail all your reasons for wanting to remain in the UK as part of your claim. Grant of Humanitarian Protection – If you do not qualify as a refugee but it is accepted that you have a need for international protection, you will be granted Humanitarian Protection. If you are granted Humanitarian Protection, you will be granted permission to stay for a minimum of five years.

If there is a significant change of circumstances in the country you fled from during your initial grant of leave and you no longer require international protection or if there is other evidence that shows that Humanitarian Protection is no longer appropriate, the Home Office may review your status.

Individuals granted Humanitarian Protection can apply for settlement after five years on the protection route. Applications for settlement should be made in the last 28 days of your leave.

Grant of refugee status – If the outcome of your asylum claim is that you were granted refugee status, you will also be granted permission to stay for a minimum of five years in the UK.

During that period of limited leave, if there is a significant and non-temporary change in your country conditions, it may be decided to review grants of refugee status. Your status may also be reviewed if the Home Office receive information relating to your actions which may mean that you are not eligible to be granted refugee status such as if your refugee status was obtained by misrepresentation.

Individuals granted refugee status can apply for settlement after five years on the protection route. Applications for settlement can be made in the last 28 days of your leave.
