YOUR EX SAYS YOU HAVE TO LEAVE THE FAMILY HOME. DO YOU?

When a relationship ends, arguments about who stays in the family home can become extremely stressful.

You might be told that the house belongs to your former partner, that your name isn't on the mortgage, or that you need to find somewhere else to live immediately.

But being told to leave doesn't automatically mean you have no right to remain.

Your legal position can depend on whether you were married, how the property is owned and the wider circumstances.

Before making a decision that affects where you and your children live, it's important to understand your position rather than relying on what your former partner tells you.

If you're facing uncertainty about the family home following separation, specialist advice can help you understand the issues affecting your circumstances.

HOW LONG HAVE YOU BEEN PUTTING THIS OFF?

Perhaps you've been thinking about separation for months.

Perhaps you know that a financial issue needs resolving, but you haven't been sure where to begin.

Or perhaps something about your current family arrangements isn't working, and you keep hoping it will sort itself out.

It's understandable to put off difficult conversations, particularly when you don't know what the consequences might be.

But getting advice doesn't mean you've committed yourself to a particular decision.

It means you can understand your legal position and consider your options with a clearer picture of the situation.

If there's a family law issue you've been putting off, an initial consultation could be a useful place to start.

WHO GETS THE FAMILY PET WHEN YOU SEPARATE?

For many people, a dog or cat isn't simply a pet. They're part of the family.

When a relationship ends, both partners may feel strongly attached to the animal. One may have paid for the pet, while the other has been responsible for much of its day-to-day care.

But the legal position isn't the same as it is for decisions about children.

Pets are generally treated as property under the law in England and Wales. There isn't an automatic system of shared pet custody simply because both people love the animal.

The circumstances can matter when ownership is disputed, and an agreement may be possible where both people are willing to consider the practical arrangements.

If a disagreement about a family pet has become part of a wider separation, getting advice about your circumstances can help you understand the position.

YOU'VE RECEIVED A COURT APPLICATION ABOUT YOUR CHILDREN. WHAT HAPPENS NEXT?

Receiving court papers about your children can be daunting, particularly when emotions are already running high.

You may disagree with what has been said. You may be worried about what the application means for your relationship with your children. Or you may simply be unsure what you're expected to do.

The first thing is not to ignore the paperwork.

Court documents can contain important information about deadlines, hearings and the issues the court is being asked to consider.

The appropriate response will depend on the circumstances, so it's important not to assume that somebody else's experience tells you what you should do.

In cases involving children, their welfare is central to the court's consideration.

If you've received an application and are unsure about your position, getting advice specific to your circumstances can help you understand the process and what may be required of you.

YOU'RE GETTING DIVORCED. WHAT HAPPENS TO YOUR WILL?

It's easy to focus on the immediate issues during separation and overlook other important arrangements.

Your will is one of them.

Divorce does not automatically cancel your existing will. However, once the divorce is legally final, your former spouse is generally treated as having died before you for the purposes of your will, unless the will provides otherwise.

That can affect who inherits from you and who carries out the wishes you've recorded.

It's also important to understand that simply separating doesn't have the same legal effect as a completed divorce.

If you're going through divorce, reviewing your will as part of the wider process can help you make sure your arrangements still reflect your wishes.

WHAT HAPPENS TO YOUR PENSION WHEN YOU DIVORCE?

When couples separate, attention often turns to the family home, savings and day-to-day finances.

But pensions can be one of the most significant assets involved in a divorce, particularly after a long marriage or where one person has built up substantial retirement benefits.

A pension being held in one person's name doesn't automatically mean it can be ignored when the wider financial position is considered.

There are different ways pensions may be dealt with as part of a financial settlement. The appropriate approach depends on the circumstances, the type of pension and the needs of both people.

It's also important not to assume that two assets with apparently similar values will necessarily provide the same financial benefit in the future.

If you're going through divorce and haven't considered the pensions, it may be worth understanding how they fit into the wider financial picture before agreeing a settlement.

YOUR EX ISN'T PAYING MAINTENANCE. CAN YOU STOP THEM SEEING THE CHILDREN?

When money is tight and one parent isn't contributing as expected, frustration is understandable.

But child maintenance and arrangements for children are separate issues.

Unpaid maintenance doesn't automatically justify stopping a child's time with their other parent. Equally, disagreements about contact aren't a way to resolve unpaid maintenance.

The circumstances of each family matter, and where both issues are causing difficulty, it's important to understand the appropriate options for dealing with each one.

If you're dealing with a disagreement about child maintenance or arrangements for your children, specialist advice can help you understand your position.

YOU CAN ASK FOR HELP BEFORE IT BECOMES A CRISIS.

Family law advice isn't only something you need when you've received a court application or everything has fallen apart.

Sometimes the most useful time to get advice is earlier.

When you're beginning to think about separation.

When you're worried about what might happen to the children.

When you aren't sure what your financial position could look like.

Or when you're simply trying to understand what your options are.

Getting advice doesn't mean you've committed yourself to a particular course of action.

It means you have more information before making important decisions.

If something has been worrying you for a while, perhaps it's time to talk it through.

BEFORE YOU MAKE A BIG DECISION...

Separation can create pressure to make decisions quickly.

Where will you live?

What happens with the children?

What should happen to the house?

What about the finances?

Some decisions can have consequences that last long after the immediate situation has passed.

That's why getting advice before you commit to an important decision can be worthwhile.

You don't need to know exactly what you want to happen.

You simply need to understand your position well enough to make an informed decision about what comes next.

If you're facing an important family law decision, Family Law Consultants can help you understand the legal issues affecting your circumstances.
