To be valid a Lasting Power of Attorney needs to be registered with the Office of the Public Guardian. There is a further twist - to be able to use the LPA it has to be first registered with a variety of organisations eg banks, building societies. To speed up the process after 17 July 2020 an on line search can be undertaken provided you follow the steps to creating an account.
LPA's created before 17 July 2020 will be subject to a phased roll out.

It's important for you to realise that if you are unmarried and living with your partner you are in a vulnerable financial position.
If your partner dies without making a will then the Rules of Intestacy apply:
If you have children together your children would inherit everything and you would get nothing! Instead you would be left having to make a financial claim through the courts against your deceased partners estate.
Even worse .........
If you are living with your partner and have no children and your partner dies without a will then your partner's parents inherit everything and you get nothing!

Are you or your clients due a refund? Between 1st April 2013 and 31st March 2017 anyone who made a Lasting Power of Attorney was overcharged by the Office of the Public Guardian and are entitled to a partial refund of the fee they paid on registration. However only a quarter entitled have claimed their refunds. If you or someone you know is affected then it is well worth doing so and the process is easy. .

All those eligible for a partial refund on their power of attorney fees can apply from today (1 February 2018).

I recently came across an old journal of my grandfather and discovered things I never knew about him.
When Attorneys step into their role under a Lasting Power of Attorney it’s useful to know and understand the history of the person they act for. Without documenting precious memories there is a danger that those memories will be lost forever. A starting point is to have gentle conversations I love this book for it’s querky questions
