Mental health might be invisible but its legal impact isn’t.

This week is and for the transport industry - where over 95% of the workforce is male, mental health too often becomes the elephant in the cab. Yet for fleets, ignoring it isn’t just a wellbeing issue, it’s a legal one.

⚠️ 95% of the logistics workforce is male, a demographic statistically less likely to disclose mental health struggles (Source: British Safety Council, 2023)

⚠️ 30% of illnesses in the transport and logistics industry are mental-health related, according to self-reported data - the real figure may be even higher (Source: MIND, cited in British Safety Council, 2023)

Driver wellbeing: more than just a passing conversation

What happens in the first few minutes after a serious road traffic incident, what we call the "Golden Minutes", can result in serious legal consequences for drivers and their employers. What a driver says whilst vulnerable and in shock can make or break a case.

However, driver and employer responsibilities start long before the driver even steps foot into their cab, as outlined during a recent inquiry before the Traffic Commissioner following a bridge strike – a case that laid bare the consequences of poor planning and failing to take into account or prioritise driver wellbeing.

In order for employers to minimise the risk of a serious incident occurring in the first place, company policies and procedures should take into account not only a driver’s physical wellbeing or medical condition, but also their emotional and mental wellbeing and any personal circumstances that may impact their ability to properly concentrate or drive safely. Failure to do so may be exposing businesses to significant risk.

Driving, Eyesight and the Law: Is Reform on the Horizon?

A recent inquest has brought renewed attention to the UK’s current approach to visual standards for drivers, particularly the reliance on self-reporting to the DVLA.

Following several tragic incidents involving drivers with known eyesight issues, a report compiled by HM Senior Coroner for Lancashire, Dr James Adeley, has prompted legal and policy discussions around whether more robust safeguards are needed to prevent such incidents occurring in the future.

Whilst professional drivers with HGV or PCV entitlements on their licences are already subject to stricter requirements, the Department for Transport is likely to now consider what changes are necessary for all licence holders, as part of its forthcoming Road Safety Strategy.

Earlier this month, we brought the courtroom to life at Bartlett Group . Using a real fatal traffic case, we explored the critical legal decisions made at every stage: from roadside interviews to cross-examination in court.
