I don’t follow the Radford family, or watch 22 Kids and Counting but I’m sure many do, and I have no doubt many people saw the episode where Noel openly talks about how he was effectively disinherited from his mother’s estate.
Noel and his brother’s loss at the share of their mother’s property comes down to poor planning. There was a Will that left mother’s share of the property to them on mother’s death but sadly, the property title wasn’t changed to ensure the asset could pass under her Will, and instead passed to her surviving spouse by the rules of survivorship. This is a scenario I see often. What actually happens on death is not as it appears in the Will and is exactly the reason professional advice from a specialist regulated solicitor should be sought.
This situation was completely avoidable and I do have sympathy for Noel and Ian.
With blended families becoming increasingly common, it is important to seek advice. You can put provision in place for your spouse, whilst absolutely protecting assets for your own children.
If you need any specialist advice, feel free to get in touch.
