Employment Tribunal Fees - Refund scheme: Watch this space
The Employment tribunal service are trying to figure how to deal with refunds of fees paid by claimants and in particular multiple claimants or cases where they have ordered an employer to reimburse the fee as part of a judgement.
Further details will be announced in September
The full text of the latest statement from Employment Tribunals (England & Wales)is as follows :
"As you are probably aware, in advance of the Supreme Court’s judgment in the Unison case an undertaking was given to the Court to refund Employment Tribunal and Employment Appeal Tribunal fees, should the Fees Order be declared unlawful.
"We are now working on the detailed arrangements of the scheme to enable that undertaking to be met and we aim to ensure that the process is as simple and unobtrusive as possible for those who make an application, while ensuring that refunds are only paid to those who are entitled. There are, however, a number of points of detail that we do need to address including, for example, how to deal with refunds in claims involving multiple claimants, and how it will operate when the tribunal has ordered the opposing party to reimburse a fee.
"Please bear with us during this period, and we hope to be in a position to make an announcement on the details of the refund scheme during September."

Employment Tribunal Claims can be made online again

After a brief withdrawal to allow the removal of the requirement to prepay fees the online service for submission of employment tribunal claims the service is online once more in Scotland, England and Wales. Claimants will no longer face the need to lodge by post or by personal visit to the designated local office.

Supreme Court decision leaves Tribunals in a snarl!
Employment Tribunals are now refusing online applications until they can update systems to remove the requirement for payment of fees... but the usual 3 time limits still apply.
Anyone seeking to issue an Employment Tribunal claim will need to complete an ET1 form and submit it by post, or in person to the relevant office.

For those who paid a fee that has been ruled unlawful, they will have to wait until full details of the refund scheme can be announced later.
