Don't assume because there is an LPA the attorney has legal authority to sell.

The presence of a Lasting Power of Attorney doesn’t mean an attorney can automatically sell the donor’s property.
✅ If the person still has capacity, the donor's consent is always required.
Or,
✅ If the there are doubts about the person's ability to consent, a decision specific capacity assessment must be completed.

LPAs are designed to safeguard people, not override their rights.

An LPA makes it easier for the people you trust to support you when you need it most.
