Can an adult child challenge a parent’s will in the UK?
Yes, but it is not easy.
An adult son or daughter is not automatically entitled to inherit from a parent. UK law generally allows a person to leave their estate to whoever they choose.
However, an adult child may still challenge a will if:
1. There are doubts about the validity of the will
For example, lack of mental capacity, pressure, fraud, or the parent not understanding what they signed.
2. They have a serious financial need
Under the Inheritance Act 1975, an adult child may claim reasonable financial provision, but being left out of the will is not enough by itself.
The stronger cases usually involve financial dependency, disability, hardship, or clear evidence of unfair pressure.
The weaker cases are where the adult child is financially independent and simply feels the decision was unfair.
Timing matters. Claims usually have strict deadlines, often 6 months from the grant of probate.
This is why legal advice should be taken early.
