In September 2026, the Provincial Court of Málaga confirmed that two Marriott Playa Andaluza timeshare contracts were null and void. The court found the contracts failed to state their required duration, and that deposits were unlawfully taken during the cooling-off period — resulting in refunds plus double the deposits paid, over £70,000, plus interest and legal costs.

Every case depends on its own contract and resort terms, so this result doesn't apply automatically to everyone. But if you own, or previously owned, a Marriott Vacation Club contract, it's worth having it reviewed to understand which legal regime applies to you and whether recent court decisions affect your position.

Fully booked pitches you can't use when you want to. Costs that keep climbing regardless of how much you actually use your holiday home this season. Travel that eats into whatever time off you did manage to get.

Summer is supposed to be the payoff for everything you've paid into your holiday park ownership over the year — the reward for the site fees, the maintenance, the upkeep. For a lot of owners, it's actually when the gap between what was promised and what's being delivered becomes hardest to ignore.

If this summer's made you question whether ownership still works for you, you're not the only one asking.

Site fees. Maintenance. Insurance. Travel there and back. Add it all up over a year, and many owners are surprised by the total — especially when they compare it to what a standard package holiday, a cruise, or a few weekends away would have cost instead.

That's not a reason to feel bad about your decision. It's just worth knowing where you actually stand.

"It'll hold its value" is one of the most common things owners tell us they were promised at the point of sale — sometimes framed as an investment, sometimes just reassurance that it wouldn't lose much if circumstances changed.

When owners actually go to sell, the reality often looks different. Resale restrictions that weren't fully explained. Buyers limited to a shortlist the park controls. Offers that come in far below what was originally paid, even after years of maintenance fees and upkeep.

It's rarely just one unlucky case — it's a pattern that shows up again and again once owners actually try to move on.

It's one of the most common promises made at the point of sale — buy the holiday home, rent it out when you're not using it, let the income offset the costs. For a lot of owners, that promise doesn't hold up once the bookings don't come in the way they were told.

The Fintech Times recently covered ECC's growth over the past decade — from a firm focused on one area of consumer disputes into a group now covering timeshare, holiday parks, retirement community properties, and overseas property mortgages.

As CEO Greg Wilson put it, the growth has come from spotting new problem areas before they're widely recognized — and holiday park and retirement property issues are exactly the kind of thing that's increasingly getting attention, including from independent press.
