A caring background can tell you a great deal about how someone will treat your family.

Meet Kym, one of our estate planners and our probate co-ordinator. Before becoming a receptionist at a local doctors surgery, Kym cared for elderly people.

Those years gave her what matters most in this work: clear communication, real empathy, and an eye for the small details that are easy to miss.

It's what clients meet when they sit down with her to plan for the future. Her focus is simple: to help people move through the process with confidence and peace of mind, and to make sure everyone leaves feeling supported and well informed.

Away from work, you'll find her paddleboarding in the fresh air or looking after her horses.

Writing down your wishes clearly is not the same as writing a Will that will be honoured.

Most people who make their own Will focus on deciding who gets what. What catches them out is whether the document stands up at all.

If a DIY Will turns out to be invalid, the estate may fall under the rules of intestacy. That means the law decides who inherits. The person who wrote the Will no longer has that say.

The mistakes we see most often are small ones:

✓ Incorrect witnessing. A Will must be signed in the presence of two independent witnesses.
✓ Ambiguous wording that can be read more than one way.
✓ Missing signatures or dates.

Any one of these can cause disputes and delays at probate, the legal process of sorting out someone's estate after they die.

So the question worth asking is whether the document meets the legal standards needed for it to stand.

A professionally reviewed Will checks compliance with current legal standards, uses clear and unambiguous wording, and offers protection against challenges and undue influence.

The cost of a DIY mistake is rarely paid by the person who made the Will. It falls to the family, at the moment they are least able to deal with it.

If you have already written your own Will, or you are thinking about it, a review is simply a way of making sure your wishes are protected.

A Will only does its job if your family can actually find it when the moment comes.

That is why document storage is part of how we work, and it comes in two parts.

The first is physical. Your Will and other important documents are kept in a professionally maintained and managed facility, rather than sitting in a drawer at home. There is no charge to retrieve them, so cost is never a reason to put off getting hold of your paperwork. It runs as an annual subscription: £30 for an individual, £45 for a couple, both including VAT.

The second is digital. Clients also receive premium access to Auderli, usually £49.99 per year. Auderli is a secure app that lets you organise and share your important life information in one place, so the details your family will need are not scattered across accounts, folders and memory.

A Will is one piece of the picture. Safe paperwork and organised information together are what spare your family the search.

If you would like to know how your documents are looked after with us, we are happy to talk it through.

💚 World Mental Health Day

Conversations about family, the future and your own wishes can be deeply personal.

At White Deer Legal, we believe those conversations should leave room for what matters to you, with time to ask questions and space to be heard.

Today is a reminder to bring that same care to our everyday conversations. Check in. Listen without judgement. Don't assume you know what someone else is carrying.

In 2021, Martin Carr took early retirement. He used that time to help his son Daniel set up White Deer Legal.

The two of them had one aim: a modern estate planning service at a price families can actually justify.

Before that, Martin spent over 40 years in banking and financial markets, setting strategy for sales and trading teams across the world. That experience sits quietly behind the work now. What you notice day to day is the care he puts into how each family is looked after.

Away from the office, he listens to music, reads and keeps fit. Most of all, he spends time with his family.

It matters who runs a firm like this one. White Deer Legal was started by a father and son, for families planning for theirs.

The moment someone loses the ability to manage their own affairs is usually the moment their family discovers they cannot step in for them.

The bank says no. The care home needs a decision. And nobody has the legal authority to give one.

Without a Lasting Power of Attorney, a legal document naming someone you trust to manage your affairs, the family usually has to apply to the Court of Protection for a Deputyship order instead. A simple application typically takes 6 to 12 months. Longer if a hearing is needed.

Bills and care decisions do not pause while a family waits.

Registering a Lasting Power of Attorney usually takes around 6 to 8 weeks. Once it is registered, it sits quietly until the day it is actually needed.

The timing matters most for an adult child supporting an ageing parent. The planning has to happen while the parent can still make their own decisions. After that point, the option is gone.

Powers of Attorney applications in the UK have reached record numbers, so more families are recognising this gap than ever before.

Will writing, power of attorney, estate administration and probate are separate pieces of the same picture. Knowing which one you need is half the relief.

If you are wondering where your family stands, book a free consultation. We will walk you through it calmly, in plain English. ✔
