Did you know there are five legal grounds on which you can contest a sibling's will in the UK?

If you have concerns about how your sibling's will was made, the law may be on your side. Whether you believe they were pressured into making it, didn't have the mental capacity to understand what they were signing, or that the will wasn't properly witnessed, there may be grounds to challenge its validity.

The five grounds are:

✅ Undue influence
✅ Lack of mental capacity
✅ Lack of valid ex*****on
✅ Fraud
✅ Want of knowledge and approval

Each one has different requirements and needs different evidence to succeed. And if a challenge is successful, the will can be declared invalid entirely.

Did you know that if your sibling passes away and leaves you out of their will, you may still have a legal claim on their estate?

It's not widely known, but if you were financially dependent on your sibling, the law may be on your side.

Under the Inheritance (Provision for Family and Dependants) Act 1975, people who were financially maintained by the person who died can apply to the court for reasonable financial provision, even if they weren't named in the will.

But there's a catch.

You only have 6 months from the grant of probate to make your claim. Miss that window and you could lose your right to do so entirely.

If you have been left out of a Will, or feel you have not been left enough, you may have more options than you think.

Under the Inheritance Act 1975, certain people including children and surviving partners can make a legal claim against an estate for reasonable financial provision. And these situations can be far more complex than most people realise.

A recent IDR Law case study explores a claim involving six children from four relationships, a surviving partner, a minor child, and a property heavy estate. With four sets of solicitors, two mediators and an infant approval hearing required, it was anything but straightforward.

But it was resolved, without going to court.

You might have seen the news that Paris Jackson has won a court battle over her father's estate, with a Los Angeles court ordering the return of $625,000 in payments made to law firms without proper approval.

But what does a US celebrity estate dispute have to do with UK trustees and executors?

Quite a lot, actually.

The principle at the heart of the case is one that applies just as firmly here in England and Wales. Good financial outcomes do not override fiduciary responsibility. Even where a decision looks sensible in hindsight, it can still be challenged if the proper process and justification were not there from the start.

Inheritance disputes in the UK are on the rise, and it is not hard to see why.

Rising property values, more complex family structures, and a growing awareness of legal rights all mean that disagreements over estates are becoming more common. And when they do arise, they often happen at the most difficult time imaginable.

The good news is that going to court is not always the answer. Mediation is increasingly being used to resolve these disputes in a way that is quicker, less costly, and far less damaging to family relationships.
