π¨ 10-YEAR ILR UPDATE β IF YOUβRE ALREADY IN THE UK, PAY ATTENTION
There is still a LOT of confusion about the proposed 10-year settlement changes.
Hereβs what we actually know π
π¬π§ The Government has proposed increasing the standard settlement period for many migrants from 5 years to 10 years under its proposed βearned settlementβ model.
β οΈ BUT β this is NOT the current ILR rule.
The Government is still analysing more than 200,000 consultation responses and developing the final model.
And this is where it gets really important:
π Transitional arrangements have not yet been finalised.
The Home Secretary has said that immigration applications are assessed under the rules in force when the application is made, rather than simply the rules that were in place when someone first arrived.
The Government has also said that, under the proposed model, lawful time already spent in the UK on a qualifying route would count towards the qualifying period once the final model is introduced.
So if your ILR is due in 2026, 2027, 2028 or later, don't assume you already know whether the proposed changes will affect you.
The final rules and transitional arrangements matter.
