A recent Family Court ruling has highlighted the importance of resolving matrimonial financial claims promptly and by way of Court Order.
In the recent case, one party started financial proceedings 20 years after the divorce in an attempt to obtain further monies from their now, significantly wealthy, former spouse.
Whilst they had agreed a settlement at the time of their divorce, they had not obtained a Court Order to endorse this, and dismiss further claims.
The Applicant did not succeed with their claim. However, had a Financial Court Order been obtained at the time of their divorce, both parties could have saved significant costs and stress.
