Proportionality is at the heart of many successful immigration cases.
Even where the rules are not strictly met, the Home Office must assess whether refusing an application would be disproportionate, particularly under Article 8 of the European Convention on Human Rights.
This involves balancing immigration control against the impact on an individual’s private and family life. A well-prepared case does not simply argue the facts, it demonstrates why a refusal would be excessive, unjust, and legally unsustainable.
When framed properly, proportionality can turn a weak case on paper into a strong case in law.
