Industrial workplaces carry risks, but employers have a duty to keep staff safe. When proper safety measures aren’t followed, accidents can happen.

Common manufacturing injuries include:
• Machinery and caught-in accidents
• Falls from platforms or ladders
• Chemical exposure, fires or explosions
• Repetitive strain and overexertion injuries
• Electrical incidents and falling objects

If your injury was caused by unsafe working conditions, you may be entitled to compensation. In Scotland, you normally have three years from the date of the accident to make a claim.

The loss of a child is something no family should ever have to endure.

In this case, a family pursued a medical negligence claim following the tragic death of their newborn baby after failures in maternity care during labour.

Medical evidence later confirmed that the baby died as a result of perinatal hypoxia following a prolonged second stage of labour. It was argued that there had been delays in recognising and responding to complications during delivery.

The case proceeded in the Court of Session, where the Defender denied fault. However, before the case reached a full hearing, settlement discussions resulted in an agreement to pay £200,000 to the family.

While no legal outcome can undo such a loss, the settlement provided recognition of the profound grief and psychological trauma experienced by the parents and enabled them to access the support they needed.

Our 77-year-old client was struck when a vehicle mounted the kerb and collided with her, causing multiple fractures, internal injuries and a permanent reduction in vision.

Liability was admitted, but the insurer initially offered £45,000. After obtaining specialist medical evidence, including ophthalmic opinion confirming accident-related vision loss, and raising Court proceedings, we challenged the valuation and negotiated a final settlement of £60,000, £15,000 more than the original offer.

Injured in a road accident abroad? You may still be able to claim in Scotland.

Our client was riding his motorcycle in France when a car pulled out from a side road and collided with him.

He suffered a serious shoulder injury requiring surgery, damage to his cervical spine, and was unable to work for two months. We obtained medical evidence, recovered his records and included his loss of earnings and vehicle losses in the claim.

Court proceedings were raised against the French insurer in the All Scotland Personal Injury Court. Liability was admitted and the case settled for £25,000.
