The Scottish Law Commission has proposed changes to Scotland’s compensation system for asbestos-related disease.

Under the current rules, an earlier diagnosis of symptom-free pleural plaques can create difficulties if someone later develops mesothelioma or another serious asbestos-related disease.

The proposed reforms would give people a fresh opportunity to pursue compensation when a symptomatic disease develops, helping to remove a technical barrier that can affect claims years after the original diagnosis.

Laura Blane, Partner at Thompsons Solicitors Scotland, says the proposals offer “the prospect of a fairer and more compassionate system, placing justice ahead of technicalities”.

The recommendations are included in a draft Damages (Scotland) Bill.

Where an employer proposes 20 or more redundancies at one establishment, collective consultation obligations may apply, depending on the circumstances.

Affected employees may therefore seek legal advice on whether they may be entitled to a Protective Award, as well as any other redundancy-related payments available to them.

Patrick McGuire spoke on BBC Radio Scotland about what should happen next for those affected by Scotland’s historic forced adoption scandal:

“The apology that we received from Nicola Sturgeon almost three years ago now is not enough.”

Women had their babies taken from them through coercive practices, and while apologies have since been made, Patrick says that words alone are not enough.

Thompsons has been working with women affected by forced adoption to seek financial justice. Patrick is calling for a redress scheme, drawing on the response to other historic injustices including infected blood and childhood abuse.
