Parental responsibility - but what does it actually mean?

You may have heard the term parental responsibility, but what does it actually mean?

In simple terms, it refers to the legal rights and responsibilities involved in bringing up a child and making important decisions about their upbringing.

It can include decisions about things such as:

🏫 Education
🏥 Medical treatment
✈️ Taking a child abroad
🏠 Where a child lives
📝 Their name

Having parental responsibility doesn't necessarily mean that a parent automatically has a right to have the child live with them or spend a particular amount of time with them.

Those are separate issues.

When parents separate, emotions can understandably run high.

Children can sometimes become caught in the middle of adult disagreements, even where neither parent intends for that to happen.

Where it is safe and appropriate, keeping communication focused on the child’s needs can help reduce conflict and provide greater stability during a difficult period.

There is no single approach that works for every family. Some parents are able to reach arrangements together, while others may need professional support or legal intervention. In some cases, concerns about a parent’s behaviour, motivation or ability to prioritise the child’s welfare may also need to be addressed.

The aim is not to suggest that one parent must “win”, or that maintaining a relationship with both parents is always appropriate. The focus should remain on arrangements that are safe, workable and in the child’s best interests.

A question I’m often asked…

“Do I really need a solicitor if we’re separating amicably?”

If you and your former partner are on good terms, you may feel that you don't need legal advice.

But even when a separation is amicable, getting advice early can help you understand your position, avoid misunderstandings and make sure that any agreement you reach is fair and properly recorded.

Good legal advice isn't about creating conflict. Sometimes, it's about helping you avoid it.

Every family's circumstances are different, so it's important to get advice that's right for you.

Protecting Non-Matrimonial Property & Children’s Interests in Financial Remedy Proceedings

Every financial remedy case following divorce is different, and the court will carefully consider the individual circumstances of the family when deciding what is fair.

In a recent case, I represented a wife in contested financial remedy proceedings where the key issues included:

🌸Whether a property acquired before the marriage should be treated as non-matrimonial property

🌸The intended purpose of funds set aside for the benefit of the child of the family

🌸Whether the original division of capital remained fair

🌸An add-back claim brought by the husband (asking the court to return money already spent by the Wife)

The outcome?

The court found in favour of the wife and confirmed that her flat was non-matrimonial property and should not be shared.

The original division of capital was upheld as fair and consistent with the parties' previous intentions. The school fees fund also remained with the wife, to be used solely for the benefit of the child.

The husband's add-back claim was not accepted.

This case highlights the importance of looking carefully at the history and purpose of assets when considering financial arrangements following divorce, particularly where non-matrimonial property and funds intended for children are involved.
