Guidance to Varying your Existing UK Immigration Application

If you have applied for permission to stay in the UK but now want your application to be considered for a grant of leave on a different basis from your initial existing application. For example, change from dependent of a student to dependent of a graduate visa application. You can vary your application if the Home Office has not yet sent a decision on your existing application.
When you do make a new application, you will be asked if you currently have an existing application on which you haven’t yet received a decision. You will be required to provide the unique reference number for that existing application. You will also be required to pay the relevant application fee and immediate health surcharge for the new application. Once you received confirmation from the Home Office that the variation application is valid. You will receive a refund of the previous application fee and an immediate health surcharge.
If you had permission when you made your application that permission will continue when you vary that application.
The date of your new application will be backdated to the date you made your previous application and not the date of variation.
Kindly note of the fact that if the Home Office has already made a decision on your application, you cannot vary it. Any application you make will be treated as a new application.

Dependants

If the new application allows you to include dependents, you can include them on your new application. It’s depending on the application form, they can either be included in your application or make an application at the same time as you, as your dependant.
If dependents were not included in the original application, the dependant will need to make a separate application and to pay the relevant application fee.
You may wish to seek independent immigration advice on whether to make a new application which will vary your previous application. If you would like to make a new application you must complete the appropriate application form, and pay any required fee.

The course will provide an overview of all aspect of UK Immigration Law. It is designed for people who are new to the field – or want the latest updates – and will be particularly useful to those sitting the OISC Accreditation Assessment at Level 1.

Through two interactive online sessions, you will gain a comprehensive knowledge and understanding of immigration law, in line with the OISC Code of Standards and Guidance of Competence at Level 1.
