π Did you watch the Martin Lewis Money Show last week? π
He highlighted some crucial financial aspects of marriage and divorce, and it got us thinking about the unique differences in divorce laws between Scotland and the rest of the UK.
π‘ Did you know? In Scotland, if you enter into a separation agreement with your spouse, you don't need court approval to split finances. Scots Law values your right to contract, making pre-nuptial and post-nuptial agreements binding here, unlike in England.
π Clean Break Policy: Scots Law emphasizes a clean break when divorcing. Assets are valued at the date of separation, and any financial arrangement (agreement or court order) is based on those values. This means no future claims can be made, even if your ex wins the lottery after separation! In England, you need a court order for a clean break.
