Inheritance tax changes could lead to further probate delays, experts warn.

Families already struggling with lengthy probate delays are being warned things could get worse from April 2027, when new rules will make pensions part of the taxable estate. Experts say this change will not only increase the number of taxable estates, but complicate the inheritance process for non-tax paying ones too, especially as executors face increasing difficulties gathering financial information.

Mike Davis, managing director at My Probate Partner warns the new inheritance tax changes could mean more estates will need to report to HMRC before a Grant of Confirmation can be applied for from the Sherif Court. This additional HMRC process currently takes a minimum of 4-6 weeks, but will certainly increase if more applications need to be signed off before probate can be applied for.

When there’s no Will, there’s still a way!

When former First Minister of Scotland, Alex Salmond, died unexpectedly in 2024 without a Will, it left behind not just personal grief, but public legal complications.
