People tend to think of estate planning as solely relating to what happens after they pass away. Whilst this is true in the context of Wills, have you ever considered what would happen if you lose the capacity to make important decisions whilst you are still alive?

If you and your partner both own a property, you are likely aware of the different types of ownership - such as Joint Tenants and Tenants In Common, which both mean very different things in spite of their similar names.

But what you may not have been aware of is the impact that this has when you pass away. Whilst joint tenants automatically pass their entire property share to the surviving owner, tenants in common hold separate, defined shares that do not pass to survivors automatically, and may need to be clearly stated in your Will.

Going through a divorce can mean a lot of things change - and your Will could be one of them.

If your Will was written before your divorce, it’s important to review it and make sure it still reflects your wishes. Simply assuming that everything will automatically be taken care of could cause confusion or complications further down the line.
