A prenup isn’t the only time couples can make a nuptial agreement.

Life doesn’t always look the same five or ten years into a marriage as it did before the wedding.

Perhaps one of you has started a business. Your financial circumstances have changed. You’ve received an inheritance. Or you simply want to put some clear arrangements in place for the future.

A postnuptial agreement allows married couples to set out their intentions about financial matters during the marriage.

It’s not about expecting a marriage to end.

Sometimes it’s simply about having a clear conversation about what you both want and putting that understanding down in writing.

“We’ve agreed everything between us. Do we still need to do anything?”

It’s a question that comes up quite often after a separation.

Reaching an agreement about your finances is an important step, but if you want that agreement to be legally binding, there is usually another step to take.

A Consent Order can formally record the financial agreement and, once approved by the court, make it legally binding.

It can cover things such as property, savings, pensions and maintenance.

So if you and your former partner have managed to reach an agreement, don’t assume the conversation is the final step. It’s worth checking that the agreement is properly formalised too.

Thinking about moving abroad with your children?

If you’re separated from your child’s other parent, a move abroad can raise some important questions, particularly if they have parental responsibility too.

You may need their permission before taking your child abroad, and if you can’t agree, there are circumstances where the court’s permission may be needed.

It’s something worth getting advice about before booking flights or making plans. The legal position can depend on the circumstances, including the length and purpose of the trip.

A move that feels straightforward to one parent can have a much bigger impact on the other, and, most importantly, on the child.

When finances are being sorted following a relationship breakdown, it’s not simply about looking at what’s in the bank account today.

Financial disclosure can involve looking at property, savings, pensions, investments, income and debts, giving both sides a clearer picture of the overall financial position.

Sometimes, separated parents can work well together when it comes to their children, but find themselves unable to agree on one particular issue.

It could be a decision about their child’s education, medical treatment, where they should live, or another important aspect of their upbringing.

These disagreements don’t necessarily mean that everything needs to become a court battle. There are legal options available when parents cannot reach agreement, including a Specific Issue Order.

Understanding what options are available can be the first step towards finding a way forward.

This week, we’re continuing our introduction to the Emin Read Family Law team with Claire, who co-heads the department alongside Laura.

Claire has been practising Family Law since qualifying as a solicitor in 2009, bringing more than 15 years of experience to her work with clients across the South East and London.

Her expertise covers a broad range of family matters, including divorce and separation, financial arrangements, child-related issues, cohabitation disputes, nuptial agreements and cases involving domestic abuse.

For Claire, it’s not just about providing legal advice. She understands that family matters can be deeply personal and often come at a particularly difficult point in someone’s life. Her calm and supportive approach, combined with clear and practical advice, helps clients understand their options and what comes next.

Where possible, Claire aims to resolve matters efficiently and amicably, helping clients avoid the unnecessary stress and expense that can come with court proceedings.

Claire sees clients from our Eastbourne, Battle, Twickenham and Balham offices, supporting people across the South East and London.

It’s time to reintroduce our Family Law team, starting with Laura.

Laura plays a central role in our Family Law Department, working alongside Claire Tennant to support clients through a wide range of family law matters.

Her career in Family Law began in 2009 and, in 2018, she co-founded the dedicated Family Law Team at Emin Read. Since then, she has continued to build on her experience across both high street and regional firms.

Laura is a qualified court advocate and trained Family Mediator, with experience across matters including domestic abuse, cohabitation and nuptial agreements, as well as the legal and financial issues that can arise when relationships come to an end.

Clients value Laura’s calm, compassionate and down-to-earth approach. She takes the time to understand each individual situation, providing clear and honest advice tailored to what matters most to her clients.

We’re pleased to have Laura as part of the Emin Read team. 💙

Parental Responsibility covers the legal responsibility for making important decisions about a child’s upbringing. This can include things such as education, medical treatment, their name and where they live.

Who has Parental Responsibility can depend on your individual circumstances, so it isn't always as straightforward as simply asking, “Who is the parent?”
