In many countries, including the UK, there is a tax-free allowance on pensions, also known as a ‘lifetime allowance’. This is the maximum amount of money that you can save into a pension during your lifetime, without having to pay extra tax. This allowance can have significant implications for divorcing couples and a change to the law is now anticipated.

Happy 2023!

This year I’d like to give a big shout out to my team at DMH Stallard LLP. The past 6 months have flown by so quickly and my first 6 months as an NQ have been made so much easier by Samantha Jago & Jessica Da Silva. We work incredibly hard but we are each other’s biggest supporters. I feel lucky to be part of the and grateful to learn from such intelligent, strong women (including the wider department!)

NEW LAW TODAY 🚨🗞️📰

From today, it is illegal for anyone under the age of 18 to marry in England and Wales.

This law has been long coming but is a positive change, helping to protect our young people and recognise that full consent must be provided to marry, and that consent should not be overridden by a parent’s consent.

I first learned about forced marriages in secondary school and I remember being baffled that my peers could be forced to marry at that time by their family. Separately, I had a couple of friends in the traveller community who (controversy aside) had been pulled out of school by that point, and the whole thing made me sad. I fully support this change in the law.

I recently wrote about business assets on divorce and what should be considered when going into business with your spouse. Here’s some top tips but read the full article here (https://www.dmhstallard.com/news-insights/blog/business-and-divorce-what-to-know-if-going-into-bu) and message me for help!

1. Firstly, have the conversation with your spouse. It is easier to discuss these matters early, rather than when you are in the midst of a relationship breakdown.

2. Secondly, take legal advice from a corporate lawyer who can draw on the experience of family lawyers to create or update a Shareholders’ or Partnership Agreement.

3. Explore what the business might look like in the event of divorce and include specific clauses around this – for example:

* buy-out provisions,
* restrictions on the involvement of future spouses without agreement (e.g. in the case of remarriage),
* what would be communicated to the business
* how the business relationship would work pending any settlement.

If you’re like me and love a good TV drama, you might have caught up with BBC’s recently.

The storyline includes an abusive relationship and the characters, Catherine in particular, talk about coercive control which can be a more subtle form of abuse that often builds over time. The programme looks at the views of the parents of the victim, how it impacts children of the family and the family’s mental health. I have had clients in my short time as an NQ diminish the abuse they have suffered because it was not physical, or not recognise their partner’s behaviour as abusive at all.

It is great to see a prime time TV show shine a light on the more “subtle” forms of abuse. If you or anyone you know needs help, reach out to a local support charity and DM me to find out what legal action can be taken to protect victims.
