Divorced = finances sorted…right?

Not necessarily!

Your divorce and your finances are two separate legal processes, and getting a Final Order in divorce doesn’t automatically end financial claims between you.

💷 What actually gets divided when you divorce?

Most people immediately think of the family home — but your financial settlement can involve much more than that.

Depending on your circumstances, the overall financial picture could include:

🏡 Property — even where it's held in one person's name
💷 Savings and investments
📈 Pensions
💼 Business interests
💳 Debts and liabilities
💰 Other assets owned by either of you

And then come the questions we hear all the time…

“But I owned that before we got married?”

“Those savings are in my name?”

“Surely my pension is mine?”

“Does that mean everything gets split 50/50?”

The answer isn't always straightforward.

Divorce finances aren't simply a case of putting everything into a pot and dividing it equally. The court looks at the circumstances of the individual family to determine what would be a fair outcome.

Divorce and a financial settlement are NOT the same thing.

This is one of the most important things to understand when you're getting divorced — and something that can easily be overlooked.

Your divorce legally ends your marriage.

Your financial settlement deals with the financial ties between you, which may include:

🏡 Your home and other property
💷 Savings and investments
📈 Pensions
💼 Businesses
💰 Income and other assets

So, if you've received your Final Order, that doesn't necessarily mean your financial claims against one another have ended.

And what if you've already agreed everything between yourselves?

That's great — but an informal agreement isn't necessarily the same as having a legally binding financial order approved by the court.

Sorting out the divorce is only one part of separating. Making sure you understand your financial position can be just as important.

It’s one of the first questions people ask when they’re considering divorce:

“Can I just do it myself?”

And the answer is — in some cases, yes.

The divorce application itself can be relatively straightforward. But getting divorced and legally sorting out your finances are two very different things, and this is where getting the right advice can become really important.

What happens to the house? 🏡
Do pensions need to be considered?
What if you’ve already agreed everything?
Can you and your ex use the same solicitor?
And what happens if your ex simply refuses to cooperate?
