PARENTS ARE NOT PERFECT

Brooklyn Beckham’s recent comments about his parents illustrates that parents are not perfect, but that seems to be a surprise to their children. Whilst most people recognise their own infallibility, conciliation can often get lost in translation when there are family rifts, whether it’s due to dissent over the wedding arrangements, as per the Beckham’s, or due to separation/divorce.

The key is for separating parties to avoid joining in the ‘blame game’ and find a constructive way forward. Round table mediatory meetings with parties and their solicitors allows parties to reach agreement in a constructive, positive environment with a structured approach and legal advice ‘on tap’. Most round table meeting with an experienced specialist family solicitor end in a cost-effective agreement and avoids a verbal war of attrition which only enhances family fractures rather than healing them.

A Cautionary Tale when considering joining in third parties

Our Lisa O'Connor is pleased to share that the Judgement in her case in HX v WX [2025] EWFC 338 (B) has been published.

This is a case where she successfully represented the Respondent Wife in contested financial remedy proceedings. The decision provides important clarity on how third party claims – particularly those based on proprietary estoppel should be approached within financial remedy proceedings.

The Judgement not only resolves the specific dispute between the parties but also contributes meaningfully to the developing body of law surrounding intervenor claims and the boundaries of remedies available to third party contributors. We as a team are proud of Lisa to have played a part in shaping this growing area of family jurisprudence.

Background to the case
This was a long relationship of some 22/23 years. The matrimonial home was jointly held by the spouses. Our firm represented the Respondent Wife.

Wife’s 92 year old mother had contributed a substantial sum towards the construction of an annexe and after FDR, she was joined as an Intervenor given Husband’s failure to acknowledge the substantial contribution she had made. The Intervenor sought a life interest in the property and a beneficial interest under the principles of proprietary estoppel.

The Judgement
The Court accepted that the Intervenor had acted in reliance on assurances and suffered detriment and that all three ingredients of proprietary estoppel had been established. A substantial costs order was made against Husband.

Why this matters and why we are proud of the result
This Judgment will be of real value to practitioners and clients where third party interests intersect with a relationship breakdown.

The case highlights that thorough pleadings and evidence are vital and these should be approached with the necessary legal rigour. Whilst Wife’s and the Intervenor’s pleadings were commended by the Judge, Husband’s were described as comprising little more than a bare denial with the Judge stating he would have struck them out in civil proceedings. They fell well short of the standard required.

Financial remedy proceedings must manage third party involvement with the precision of civil proceedings.

At Prince Family Law we are proud that our hard work was recognised in securing an excellent outcome for our client whilst also helping to clarify the legal landscape in third party claims that will guide future cases.

The case is well worth a read and should be a salutary warning to anyone considering causing a third party to intervene in family proceedings.

Finally, thank you Duncan Maxwell Stewart for his excellent representation of Wife and Stacey Pocock of CMP Legal and Eleanor D’Arcy for your hard work and representation of Wife’s mother, the Intervenor who was 92 years of age.

Well done Lisa, a fantastic achievement.

And just like that, we reach year 3 of Ladies in Business!

Yesterday we celebrated with an evening at Armisteads. It was great to see our fabulous ladies in business turn up to celebrate 3 wonderful years of networking events and meeting new people. We had old and new faces join us and it was lovely to raise a glass to new relationships formed!

This event was specifically to support The Snowdrop Project and Zarach through our charity raffle. We are delighted to have raised £410 and wish to thank all the business who donated prices and everyone who purchased tickets.

Thank you to all the ladies who have supported and worked so tirelessly to make Ladies in Business the lovely community we have today. I can’t wait to see what we bring to 2026!
