Does sharing care of your children equally mean no child maintenance is payable?

It’s not always quite that straightforward.

50/50 care means no child maintenance… doesn't it? ⚖️

Not necessarily.

OS v DT [2025] highlighted an unusual loophole in the child maintenance system.

Where parents genuinely provide exactly equal care, the CMS may have no jurisdiction to assess child maintenance. But, somewhat surprisingly, that can mean the Family Court has jurisdiction instead.

And that doesn't necessarily mean the court will order monthly maintenance either!
