🚨 Can Probate Be Stopped?

Most people assume that once someone dies, Probate automatically goes ahead.

Not always.

If there are genuine concerns about a Will or who should be dealing with the estate, it may be possible to enter a Caveat at the Probate Registry.

A Caveat acts like a pause button. It prevents a Grant of Probate (or Letters of Administration) from being issued while the concerns are investigated.

Common reasons for entering a Caveat include:

✅ Concerns about the validity of a Will
✅ Questions about the deceased's mental capacity
✅ Suspicions of undue influence or fraud
✅ Belief that a later Will exists
✅ Disputes over who should administer the estate

A Caveat is not something that should be used lightly, but in the right circumstances it can be an important way of protecting an estate until matters are resolved.

If you are an executor, administrator or beneficiary and are concerned about a Will or Probate application, obtaining advice at an early stage is often the best course of action.

Probate can be expensive. But it doesn't have to be.

In many estates, the most time-consuming and costly part is actually the work BEFORE the Grant of Probate is obtained.

That can include:

• gathering financial information
• identifying assets and liabilities
• Inheritance Tax paperwork
• tracing missing information
• dealing with banks and institutions
• preparing Probate Registry paperwork and applications

This is where Moorlands Probate Support and ST10 LAW can help.

I am Nicholas J. John, a Consultant Probate Solicitor with over 20 years’ probate experience.

I provide this service through ST10 LAW as a member of the Society of Will Writers, through which I am regulated and professionally insured.

Through Moorlands Probate Support and ST10 LAW, I provide support and assistance with the pre-Grant stage of probate only.

Importantly, Moorlands Probate Support/ST10 LAW does not itself apply for the Grant of Probate or deal with the full administration of estates.

Instead, I assist executors and families with the substantial amount of work that often needs to be completed before a Grant application is ready.

For many people, this can be a far more practical and cost-effective alternative to instructing a firm of solicitors to deal with the entire estate from start to finish.

Once matters are ready, executors can either make the application themselves or, if they don't feel comfortable doing so, I can arrange for matters to be transferred to Lovedays Solicitors, where I also work as a Consultant Probate Solicitor. Through Lovedays I will then apply for the Grant and deal with the administration of the estate if the executors want me to. No pressure!!
