Using AI without clear rules is asking for trouble.

An AI Policy isn’t about stopping innovation — it’s about using AI responsibly.

A clear policy helps:
• staff understand what AI can and can’t be used for,
• protect personal and confidential information,
• reassure clients through transparency,
• ensure decisions remain fair, ethical and lawful.

It also makes clear that AI supports human judgement — it doesn’t replace it.

In business, clarity beats chaos, and just hoping for the best, is as daft as a duck. 🦆

If your business uses AI and you don’t yet have an AI Policy, it’s time to fix that.

Let Barkley Legal create a bespoke AI policy for you.

If AI is using personal data, the law is already involved.

Under UK GDPR, individuals have rights when decisions are made using automated processes — including AI.

Businesses must be transparent about:
• whether automated decision-making is used, and
• whether personal data is processed by AI.

That information should be clearly set out in your Privacy Notice.

While some rules are due to be relaxed under new legislation, care is still needed — especially where sensitive data is involved.

Assuming AI “sorts it all out” without checking the legal position can be as daft as a duck. 🦆

Take a look at your Privacy Notice — does it reflect how your business actually uses AI?

Barkley Legal provide a document review service if you would like any assistance with this.

Speed is useful - fairness is essential.

Many businesses now use AI for recruitment, performance reviews and work allocation.
It saves time.
It cuts costs.
But it can also create serious legal risk.

AI systems rely on existing data, which isn’t always balanced or fair. That means biased decisions can creep in - often without anyone noticing until it’s too late.

Under the Equality Act 2010, employers must be able to justify decisions fairly. Delegating them to AI doesn’t remove that responsibility.

Using AI without understanding its limits can be as daft as a duck 🦆 - especially when people’s livelihoods are involved.

If AI plays a role in your employment decisions, now is the time to review how it’s being used and get an AI Policy in place. At Barkley Legal, we can assist you with this document if you would like it creating.

Many business owners assume paying for work means they automatically own it - but that isn’t always the case.

If a marketing agency, designer, consultant or Virtual Assistant creates content or materials for your business, they usually own the IP (Intellectual Property) unless a contract says otherwise.

This applies to websites, social media posts, templates, documents and systems.

Clear contracts prevent costly misunderstandings later.

If you use freelancers or VAs, reviewing your contracts is a sensible place to start. Barkley Legal offer this service to help you get everything in place. Drop us an email: [email protected] to find out more.

Just because an AI document looks impressive doesn’t mean it’s safe.

I’m increasingly asked to review legal documents created using AI — and so far, every single one produced by a non-lawyer has been unsafe.

Legal documents must be accurate, precise and word-perfect. AI doesn’t understand context, consequences or what’s missing.

The real risk?
You only discover the problem when a dispute arises.

If AI gets it wrong, there’s no one you can realistically sue.

AI can help with admin and ideas — but when it comes to legal documents, guessing is as daft as a duck. 🦆

Before you rely on AI-generated legal content, speak to Barkley Legal.

I was humbled by the recent praise I received from Tracy Lewis.

…‘I am delighted to provide this testimonial for Anne.

One of Anne's standout qualities is her ability to bridge the gap between the legal jargon and everyday language. She ensures that her clients are not overwhelmed by legal terminology but are instead empowered with knowledge in a clear and accessible manner. Her commitment to making the law understandable to her clients is a testament to her dedication and empathy.

Furthermore, Anne's Terms and Conditions (Ts & Cs) are skilfully composed in a straightforward and user-friendly manner, making them engaging and comprehensible to your clients, encouraging them to read and understand the content.’…

How often have you been given a set of terms and conditions and not really understood all the terminology and content? I support a wide variety of small business, if you would like to become one of them, please get in touch:

Everyone seems to be using AI — but following the crowd isn’t always a good idea.

Artificial Intelligence is everywhere at the moment, and it’s tempting to jump in because everyone else is doing it.

But when it comes to AI, blind adoption can be as daft as a duck. 🦆

AI is a tool, not a decision-maker. It doesn’t replace judgement, experience or legal responsibility - and it certainly doesn’t sit outside the law.

If something would be unlawful when done by a human, it doesn’t become lawful just because a computer did it instead.

Before you rely on AI in your business, it’s worth stopping to ask:
Are we using it wisely — or just following the flock?

If you’re unsure whether your use of AI is legally sound, please get in touch.

Intellectual Property (IP) is one of those legal terms many business owners hear often - but rarely fully understand.

Your business IP includes more than just your logo or name. It can cover your website content, social media posts, documents, branding, training materials and systems.

If you don’t know what IP your business owns - or who created it - you may be leaving valuable assets unprotected.

If you’d like clarity on your business IP, professional advice can help you identify and protect what matters. Barkley Legal are here to help, get in touch to find out how:

Half of small businesses are hit by cybercrime every year - are you prepared?

Cybercrime and GDPR are closely linked. If client data is hacked, you must report it to the ICO - and tell your clients their information is on the dark web. That can destroy trust instantly. While no business can ever be 100% secure, you’re expected to take reasonable steps: staff training, Cyber Essentials, cyber insurance, checklists for new starters, and strict access controls when people leave.
Cyber security isn’t just IT—it’s a legal and business survival issue.

Review your documents and systems to ensure they reflect your current business practices.

If you’re worried about any of these issues or don’t have everything in place, Barkley Legal can help you protect your business for 2026: https://barkleylegal.co.uk

“One of the most sincere forms of respect is actually listening to what another has to say.”
Bryant H. McGill

I love this quote. Some of my family and friends may well say I’m in fact more of a listener than someone who never stops talking. Anyhow, it has always put me in good stead for my business. I think this is reflected in the testimonial Rachel kindly left me:

…’Anne has been an absolute star in helping me with the legal side of setting my business up. She has drafted my Terms and Conditions, Contracts of Sale, GDPR to name a few.

I cannot recommend Anne highly enough, she was extremely patient, great with keeping in contact and explained everything clearly and concisely. I would have been lost without her’...

If you received a Subject Access Request tomorrow, could you respond within 30 days?

GDPR applies to every business, yet many rely on an outdated “privacy policy” written by a web designer - one that covers only the website, not the business. Your Privacy Notice must reflect everything you do, including marketing, CCTV, using client photos, staff processes, data access, and breach reporting. Everyone on your team should understand SARs, the 72-hour breach rule, and what information must - and must not - be shared.

Staying compliant prevents fines, protects your reputation, and builds trust.
