✒️A will is a legal document that states Who receives your assets after you die, Who will be guardian of minor children Who will administer your estate (the executor). A will takes effect only after death and usually must go through probate (a court process that validates the will).

✒️Wills become part of the public record, they are generally simpler and cheaper to create.

🖊️A Trust is a legal arrangement where assets are placed under the control of a trustee to manage for beneficiaries. it can take effect during your lifetime (living trust) or after death. Often avoids probate, allowing faster distribution.

🖊️Trusts can control how and when beneficiaries receive money (e.g., at certain ages or conditions), they are typically more complex and expensive to set up. A trust is usually private, rather than going on the public record.

𝗦𝗲𝗰𝗼𝗻𝗱 𝗠𝗮𝗿𝗿𝗶𝗮𝗴𝗲? 𝗧𝗵𝗶𝘀 𝗶𝘀 𝘄𝗼𝗿𝘁𝗵 𝗮 𝗿𝗲𝗮𝗱...

Most people assume that wills and procedures after we pass away are all taken care of equally, and hope that their estate and hard-earned wealth will pass on to their loved ones upon their deaths.

But this will not happen for many unless careful arrangements have been made to protect their assets from being taken as they get older to pay for care home fees.

✍🏼The solution to help protect some of your estate is a Will incorporating a Property Protection Trust.

A Testamentary Property Protection Trust can only be executed whilst both partners are alive. Upon the death of the first partner, their Will specifies that their share of the property is placed into a trust and ensures that their beneficiaries (normally their children).
The surviving partner, under the terms of the Trust, has the unequivocal right to remain living in the property for the rest of their life.

📜 On the death of the surviving partner the Trust comes to an end and the property passes to the beneficiaries.
As the surviving partner does not own the deceased share of the property, it is fully protected for the beneficiaries, should the surviving partner remarry or require long term care.

💑 If you are in a second marriage, the Property Protection trust can help ensure that any children from previous marriages inherit their share of the property
It allows the surviving partner the ability to live in the property for the rest of their life and if the surviving partner wants to move to another property, they can still sell the property and the proceeds can be used to purchase a new property, the terms of the trust remain over the new property.

These types of Trusts are not suitable for everyone but Platinum Legal Services will assess your circumstances and arrange the most appropriate trust that will provide the best protection for you and,your family.
