When your child is struggling at school, knowing what to do next isn’t always straightforward.
 
Is their IDP or EHCP still right for them? What happens if agreed support isn’t being delivered? Can you ask for their plan to be changed? And what options are available if their current educational setting isn’t meeting their needs?

What happens when a traditional school setting simply isn’t working for a child?
 
For some children with complex additional or special educational needs, accessing education in a traditional school environment can be extremely difficult.
 
One option you may have heard mentioned is EOTAS – Education Other Than At School.
 
EOTAS can provide education outside a traditional school setting, with provision tailored around the needs of the individual child.
 
Our specialist Education Law team recently supported a family whose two children had complex educational needs and had struggled to access suitable education.
 
Following two complex appeals, the team helped secure EOTAS provision for both children, specialist transport arrangements and changes to their EHCPs to better reflect their individual needs.
 
Their parent later described the outcomes as “excellent” and said the team’s support made an “enormously stressful process feel structured and manageable.”

Securing the right educational support for your child can feel like an overwhelming process.

When our client’s son, who has significant additional learning needs, was initially denied a specialist school placement, the family turned to our Education Law team for help.

Rhys Palmer, Dannielle Howard and Ffion Davies supported the family through the process, gathering evidence and submitting robust grounds of appeal. Following negotiations, the team successfully secured a specialist placement and comprehensive IDP for our client’s son – without the need for a Tribunal hearing.

Our client described the team as “thorough, knowledgeable and incredibly responsive” and said the family now has the support, placement and provision their son needs.

If your child has an IDP or EHCP, is everything ready for the new school year?

For parents of children with additional or special educational needs, getting ready to go back to school can involve much more than new uniform, shoes and stationery.

The start of a new academic year is a useful opportunity to look again at your child’s needs, the support they’re due to receive and whether their current educational arrangements are working for them.

We’ve put together five things you may want to check before the new term begins. 👆

Meet Rhys Palmer, our Education Law expert.

From a child struggling to get the right support at school to a university student facing an academic appeal, problems in education can have a huge impact on individuals and their families. But many people don’t realise that specialist legal support is available.

Rhys Palmer is an Associate Director at Robertsons and leads our specialist Education Law team, supporting children, parents and students across England and Wales – from nursery right through to university and PhD level. 🎓

Rhys and the team advise on issues including additional and special educational needs, EHCPs, school exclusions, disability discrimination, disputes with schools and local authorities, and complex university matters including academic appeals, disciplinary proceedings and academic misconduct. For Rhys, it’s an area of law where the outcome can make a very real difference.

Over the coming weeks, we’ll be sharing more advice and insight from Rhys and the Education Law team on some of the issues affecting children, families and students as the new academic year begins. 📚

Four people. Four career milestones. Plenty to celebrate. It’s been a busy few weeks at Robertsons, with some exciting career news from across the firm.

Leah Donovan has qualified as a Solicitor in our Commercial Property department. Olivia James has started her training contract, beginning her first seat in our Litigation department. And there are double celebrations in our Residential Conveyancing team, with Kim Swallow and Robin Street both promoted to Lead Senior Associate.

From starting a training contract and qualifying as a solicitor to progressing into senior roles, we’re proud to see our people developing their careers at every stage.
