🏠 Restrictive Covenants: Are They Always Enforceable?

Many homeowners discover restrictive covenants when buying or developing property, but can these historic restrictions be challenged?

A recent Upper Tribunal case involved a landowner seeking permission to build a second home on land subject to a covenant dating back nearly 40 years. Despite objections from neighbours, the Tribunal ruled that the covenant could be modified because it prevented the reasonable use of the land.

The decision is an important reminder that restrictive covenants don't always prevent development, although neighbouring property owners may still be entitled to compensation.
