At the request of APIL* we are pleased to share Rusty's Story, which demonstrates perfectly how critical the law on compensation is to victims of negligence. Rusty was not our client, but his experience is at times, very similar to those of injured people whom we have represented.
There can be a perception that claiming compensation is in some way unseemly, or not the thing to do. A perception the insurance industry would almost certainly not discourage.

Motor insurance premiums up because of vehicle repair costs - seriously?
Latest analysis of Office for National Statistics data on the insurance industry by the Association of Personal Injury Lawyers (APIL) has confirmed that since the Whiplash Reforms were introduced on 31.05.21, the total costs of injury claims paid out by insurers fell by 26%. In the same period, insurance premiums have increased on average by 59%. The justification for this? Insurers claim that increased vehicle repair costs are the cause. However, according to APIL, the latest ONS data shows that vehicle repair and theft claims inflation over the same period is up by only 23%. Maybe something to bear in mind when your insurer wants more money from you at renewal time.

Ambiguous comment by Review Solicitors - I came across a comment by the legal services review site called Review Solicitors today which states that "Unfortunately Alyson France & Co are not taking on new clients at the moment through Review Solicitors". To avoid any doubt, we are very much open for business and serving our clients as usual. We also continue to take on new clients and have made the decision not to associate ourselves with a comparison website who require payment and exercise control over what reviews appear on their website. The reviews on our AF&Co website and the Google reviews (apart from one) are all from genuine clients who have provided their comments willingly and without inducement. They speak for themselves.

Have the 2021 "Whiplash Reforms" in car accident claims delivered on what was promised? - In a word, "No".
The Office for National Statistics data as at January 2023 confirms as much.

What was promised:-
- The reforms would lower car insurance premiums - They didn't. Premiums have gone up by 19%. In the same period, the cost of injury claims received by motor insurers fell by 15%.

- The new "Official Injury Claim" process would make it easy for people in car accidents to bring their own claims without legal help - It didn't. Only 9% have chosen to do it without legal help.

- Access to justice would be easier. It isn't. There was an 11% increase in road casualties, but a 20% fall in claims registered.

A review of these reforms is under way. It can only be hoped that this flawed and broken system can be fixed soon as the only winners at the moment are the motor insurers.

Currently, these changes do not affect cyclists and other vulnerable road users. Long may that continue.

More changes to costs rules in cycle accident and other injury claims have just been brought in by the Ministry of Justice. In short, they affect the operation of what is called Qualified One Way Costs Shifting or "QOCS". This will almost certainly see an increase in opponents' insurance companies making early offers of settlement in the hope that if an injured person fails to beat their offer (should the claim got to a trial or final hearing), then they will be able to claim more money back from the injured person, not only from out of the compensation which is awarded, but also from any costs and interest awarded as well. It is more important than ever to make sure that anyone finding themselves in that situation obtains clear, honest, practical advice from a professional who understands the risks posed by these recent changes.
