Landlord Covenants & Successor Liability
1. Original Landlord
• Selling the leasehold reversion does not automatically release the landlord from obligations.
• Under LT(C)A 1995, the landlord can serve a notice to the tenant requesting release.
• If the tenant does not object within 4 weeks, the release is automatic.
• Personal covenants (specific to the original landlord) are not released.
2. Successor Landlord
• Bound by all landlord covenants from the date they acquire the property, except covenants waived or released beforehand.
• Personal covenants of the original landlord do not bind the successor.
3. Limiting Liability
• Landlords can contractually limit liability to the period they owned the property (Avonridge v Mashru).
