You’ve agreed your finances… but is your agreement actually legally binding? 👀

If you and your ex have reached an agreement about your finances, a Consent Order can turn that agreement into a legally binding court order.

It can deal with things like the family home, savings, pensions and other assets.

💡 An agreement between you isn’t necessarily enough to protect you in the future.

What if my ex won’t let me see my children? 💔⚖️

If you’re being prevented from spending time with your children, it can feel incredibly upsetting and overwhelming.

The first step is usually to try to understand why contact is being refused and whether an agreement can be reached.

Depending on the circumstances, options may include:
💬 Mediation
🤝 Agreeing a parenting arrangement
⚖️ Applying to the court for a Child Arrangements Order

Importantly, don’t simply assume that you have no rights to see your children because your ex is refusing contact.

Every family situation is different, particularly where there are concerns about a child’s safety or welfare.

Who is Cafcass? 👧⚖️

If you’re involved in private children proceedings, you may hear the name Cafcass mentioned, but who are they?

Cafcass stands for the Children and Family Court Advisory and Support Service.

Their role is to safeguard and promote the welfare of children involved in family court proceedings in England.

A Cafcass Family Court Adviser may:
👂 Speak to you and the other parent
👧 Speak to your child, where appropriate
🔎 Consider any safeguarding concerns
📋 Provide advice and recommendations to the court about what may be in the child’s best interests

Cafcass does not make the final decision about arrangements for your children, that is the role of the court.

💡 If Cafcass becomes involved in your case, it’s important to understand their role and what to expect.

💡 Will the court accept any agreement that my ex-spouse and I agree, even if it’s not an equal split? ⚖️

Not necessarily.

You don’t have to agree to a 50/50 split for an agreement to be approved by the court.

However, the court will consider whether the proposed financial settlement is fair and reasonable in the circumstances.

Factors such as your income, assets, housing needs, children and future financial needs can all be relevant.

So, just because you and your ex spouse agree doesn’t necessarily mean the court will simply rubber stamp it.

💡 A fair settlement isn’t always an equal settlement.

If you’re considering agreeing your finances, getting legal advice can help you understand whether the proposed agreement is likely to be considered appropriate and fair before you finalise it.

What is a Consent Order? ✍️

If you and your ex spouse have agreed how your finances will be dealt with following separation or divorce, a Consent Order can make that agreement legally binding.

It can set out what happens to:
🏠 The family home
💰 Savings and investments
💳 Debts
💷 Pensions
📄 Other financial assets

Even if you have reached an agreement amicably, it’s important to get the agreement properly documented and approved by the Court.

An agreement between you and your ex spouse isn’t legally binding until a Consent Order has been approved by the court.
