🌟 Important Update: Major Changes to UK Skilled Worker and Business Mobility Routes 🌟

The UK government has announced significant reforms to the Skilled Worker route and related work visa categories, effective from 22 July 2025. These changes aim to refine eligibility and enhance the immigration system. Here’s what you need to know:

🔑 Key Changes:

1. Skill Level Requirements:
- The skill threshold for Skilled Worker visas will rise from RQF level 3 to RQF level 6, reducing the number of qualifying occupations by around 180.
- New tables will structure eligible occupations and salary rates for RQF level 6+ and RQF levels 3-5. Transitional arrangements will allow current visa holders to renew or change jobs below RQF level 6 temporarily.

2. Increased Salary Requirements:
- Standard salary threshold will increase to £41,700 (up from £38,700).
- PhD discount will be set at £37,500 and £33,400 for PhDs in STEM and new entrants.
- Transitional rates apply for those with Skilled Worker leave prior to 4 April 2024.

3. Immigration Salary List and Temporary Shortage List:
- The ISL will be phased out and replaced by a Temporary Shortage List for select lower-skill occupations with strict eligibility criteria.

4. Dependants:
- Generally, dependants will not be permitted for Skilled Workers in occupations below RQF level 6, with some exemptions for existing holders.

5. Global Business Mobility Route:
- Minimum salary thresholds will increase to £52,500.

6. Scale-Up Route:
- Salary threshold will rise to £39,100, along with clarified rules on salary calculations.

7. Special Provisions for Care Sector Roles:
- Additional controls will be implemented for care workers, including continuous employment requirements and Care Quality Commission (CQC) regulation.

🚨 Important Update on UK Citizenship Guidance 🚨

Big changes are happening in the UK's citizenship process, especially impacting refugees. The Good Character guidance has been updated, and here's what you need to know:

🔹 New Clarifications: From 10 February 2025, anyone who previously entered the UK illegally will generally be refused British citizenship. This applies even if the entry happened years ago.

🔹 Dangerous Journeys: Those who arrived without valid entry clearance or electronic travel authorization, especially through dangerous journeys like small boats or concealed transport, will usually be denied citizenship.

🔹 Impact on Refugees: This has major implications for refugees. Despite being recognized as needing protection, many may find it nearly impossible to naturalize due to these new rules.

🔹 No Right of Appeal: Citizenship applications are costly, and with no right of appeal against refusals, many might be discouraged from applying

🔹 Children Not Exempt: Despite some reports, children who entered illegally are still at risk unless it's proven their entry was beyond their control. The decision is left to the discretion of a Home Office caseworker.

🔹 Permanent Barriers: Refugees granted indefinite leave to remain can't apply for their home country passports without risking their status in the UK. This leaves them dependent on refugee travel documents, complicating travel.

🔹 Sponsorship Costs for Skilled Workers:
Effective December 31, 2024, employers can no longer pass certain sponsorship costs onto Skilled Workers. This includes the Sponsor Licence Fee and Certificate of Sponsorship Fee. Compliance is crucial, as violations could lead to sponsor licence revocation.

🔹 Electronic Travel Authorisation (ETA):
Starting January 8, 2025, the ETA becomes mandatory for non-European nationals traveling to the UK. This new requirement aims to enhance travel security and streamline entry processes.

- Key Dates:
- Non-European Nationals: Apply from November 27, 2024.
- European Nationals: Apply from March 5, 2025; ETA required from April 2, 2025.
- Universal Requirement: By April 2025, all travelers (except British and Irish citizens) will need an ETA or an eVisa.

🌍 Exciting News for EU Settlement Scheme Holders! 🇬🇧

The UK Home Office has announced some important changes to the EU Settlement Scheme that will make it easier for pre-settled status holders to transition to settled status! 🎉

👉 Key Highlights:
- Automatic Conversion: A new process will automatically convert eligible pre-settled status holders to settled status without requiring a new application!
- Phase One: Before your pre-settled status expires, it will be extended by five years to ensure you don’t lose your rights. Automated checks will then confirm your eligibility for settled status.
- No Action Required: If you qualify, you’ll receive a notification and your digital status will be updated automatically!

🔜 The first grants of settled status are expected to be issued in the coming weeks, and if you need further information, the Home Office will reach out to you.

📢 Client Enquiry: ILR Eligibility on a Skilled Worker Visa 📢

Today, a client reached out with an important question regarding eligibility for Indefinite Leave to Remain (ILR) after nearly completing the 5-year requirement on a Skilled Worker visa. However, his situation changed recently—his employer unfortunately let him go just three months before he would have reached the five-year milestone.

💼 Does he still qualify for ILR if he’s no longer in the job?

👉 My Advice: Under current ILR rules, applicants must still be employed and able to provide confirmation from their employer. This letter must confirm that they are needed in their role both now and after obtaining ILR, in line with salary requirements.

🔑 Key Point: If you're on a Skilled Worker or T2 visa, maintaining active employment is crucial when applying for ILR. It’s also essential to provide evidence of ongoing employment from your current employer.

Biometric Residence Permits (BRPs) are set to expire by the end of December 2024 and will be replaced with eVisas. This change may cause confusion and issues for individuals, particularly in proving their immigration status to employers and landlords.

🔹 It is crucial for individuals to apply for their eVisas before their BRPs expire to avoid any complications. Those with indefinite leave on older documents are advised to make a No Time Limit application to secure an eVisa.

🔹 Despite the transition, individuals with expired BRPs but valid leave will still be able to use online right to work and rent services. It is recommended to retain the BRP for future applications and international travel until it expires.

🔹 This transition is expected to pose challenges, and individuals experiencing issues with eVisas should seek assistance.
