We like to think that everyone has our best interests at heart

But that's not always the case

We've probably all encountered situations where our spouse hasn't acted in our best interests

This is why there can't be a legal assumption that we want our next of kin to make decisions on our behalf

If you want your next of kin to be able to make decisions on your behalf, you need to appoint them as your Attorney by creating a Lasting Power of Attorney

Without this in place, they are not able to make any decisions on your behalf should the need arise

Because both of you have access to any joint assets, it's easy to believe that they're not affected if one of you loses the ability to make decisions

After all, the one with mental capacity can still access and control them

However, this isn't the case

Joint assets can be frozen - unless you have an LPA in place that names you as an Attorney

Without an LPA, you need to go through the Court of Protection and be appointed for deputyship before you can access the assets again

As much as we want to hope that our Estate Plans won't be used until we're old and grey, that might not be the case

Unfortunately, accidents happen, unexpected illnesses happen, and before we know it, our plans might have to be used

If this happens when we're younger, it could mean that our children are not considered in our plans

Unless our children are over the age of 18, they're unable to directly inherit anything from us, and they need to have someone to look after them

Because of this, they need to be carefully considered and included in Wills

Whether it's through placing their inheritance in a Trust, accessible once they reach the age of 18

However, it's simply not true

Unless you're able to see into the future, there's no knowing what tomorrow holds

Do you know what to include in your Estate Planning?

There's no one-size-fits all checklist (unfortunately 😞)

So let's cover the basics and where you can start

- Do you have a valid Will in place?

- If your Will was written some time ago, has it been updated recently?

- Do you have a Lasting Power of Attorney in place?

- Are your Attorneys still able to carry out their duties when required?

- Do you have Trusts set up to protect your Assets if needed?

- Have you named Guardians for your children, if needed?

It can be difficult knowing when to have the conversation

But it can give your loved ones peace of mind knowing that your Estate Planning is all in place

If you're unsure how to approach the conversation, start with the basics

Let your executor know you've appointed them

Tell your loved ones where your Estate Plans are, just in case they're needed

And most of all, let your loved ones know you've thought of them and that there's nothing to worry about

While you can appoint a single person to act as your Attorney, you don't have to

Legally, there is no upper limit to the number of Attorneys you can have named in your LPA

What you have to decide is how they're going to act

πŸ‘₯ Jointly - every decision needs to be agreed upon by all of your Attorneys, the more Attorneys you have, the more complicated this becomes

πŸ‘₯ /πŸ‘€ Jointly and Severally - your Attorneys can act alone, or with the other Attorneys

You can even specify whether certain decisions are to be made "Jointly" or "Jointly and Severally"

It's a lot to take in, but in short, you don't need to appoint only a single Attorney, and while there is no legal upper limit, consider the logistics of needing to discuss decisions between Attorneys
