R v PK - Harwood Solicitors represented a client facing charges of Conspiracy to Control Prostitution for Gain

1 week into a 3 week trial at Preston Crown Court the prosecution offered no evidence following complex legal arguments and submissions made by us. The jury returned a NOT GUILTY verdict.

In order to convict an accused person, the Crown Prosecutor must prove beyond a reasonable doubt that the accused person committed the criminal offence that they are charged with.

To do this they must prove

(1) that the person engaged in criminal behaviour and

(2) that they had the state of mind required for that crime.

Both these elements - the act and the intention - must be proven.

Explaining the changes to the law regarding driving and using a mobile phone. 🚫🚗

The changes come into law today and if you don’t follow them you could be liable for a fine of £200 and six points on your licence.

This means:
🚫 You can’t use your phone at all while driving, unless it’s hands-free and the phone is secured in a cradle
🚦 This applies even if you’re stuck or at a standstill in traffic
📱 It also applies even if you’re not actually making a call or messaging – so scrolling through apps, changing your music or even tapping the screen to check the time is a no
❌ If you are caught using a hand-held device while driving you could be liable for a £200 fine and six points on your licence
🍔 However you can now use your phone to pay contactless at a drive-through or toll road, as long as your car is brought to a safe stop first.
