🇬🇧 Major UK Immigration Update‼️
Details of the New 10-Year Settlement Proposal Released Today

The UK Government has published “A Fairer Pathway to Settlement”, outlining a major reform to the future settlement (ILR) system. Here are the key points:

1️⃣ A New 10-Year Baseline Route to Settlement

The proposal introduces a 10-year standard pathway to ILR for most visa categories.

However, several groups may receive significant reductions (1–7 years) based on contribution or integration:

High earners (3 years at £50,270 / £125,140) → reduce 5–7 years

Public sector workers (e.g. healthcare, teaching) → reduce 5 years

Community & volunteer service → reduce 3–5 years

Global Talent / Innovator Founder → up to 7-year reduction

BNO & eligible family routes → reduce 5 years

2️⃣ Skilled Worker Visa Holders Will Be Affected

The proposal states that, apart from specific routes (BNOs, public service roles, Global Talent, etc.), the current 5-year settlement route for Skilled Workers will move to a 10-year default unless applicants meet certain contribution or integration thresholds.

This means:

Those already working in the UK on a Skilled Worker visa

Those planning for settlement after 5 years

may be affected by the change.

3️⃣ The Government Is Considering a Transition Period

The Home Office notes that whether a transition period will be offered for people already progressing towards settlement will be determined through the public consultation.

A transition period could mean that people already on the route to ILR under current rules might not be immediately impacted by the new 10-year structure.

4️⃣ Important for Anyone on the Skilled Worker Route

The consultation includes a key question:

Should people who are already on a settlement route be provided with a transition period?
Options range from Strongly Agree to Strongly Disagree.

Proposed Changes to ILR for Skilled Worker Visa Holders – What You Need to Know

This week in Westminster Hall, MPs debated two petitions opposing the Government’s proposal to extend the qualifying period for Indefinite Leave to Remain (ILR) from 5 years to 10 years. One petition called for the retention of the 5 yearILR route for Skilled Workers, and the other focused on maintaining the same route for Hong Kong BN(O) visa holders.

This debate stemmed from Gov May 2025 white paper stressing on “earned settlement”. The standard ILR route would increase to ten years, though those making exceptional contributions could qualify sooner through a points-based system. Exemptions to remain for partners of British citizens, victims of domestic abuse, and EU Settlement Scheme status holders.

A key question remains whether the changes will apply retrospectively to existing Skilled Worker and BN(O) visa holders. It is speculated that shorter ILR routes may be preserved for highly skilled or higher-salaried roles, especially those at the upper end of the RQF framework, while other occupations could face the ten-year route.
For now, no legal changes have been made. Skilled Worker visa holders remain eligible to apply for ILR after five years of continuous residence. The Immigration Minister confirmed that a public consultation will begin in autumn 2025, although no start or end dates have been set. Draft legislation may follow, but experts believe that any real changes will not take effect before 2026 at the earliest.

In the meantime, the broader aim is reflected to prioritise domestic training over reliance on overseas workers; while also allowing faster settlement for those it considers to be making meaningful contributions to the UK.

❓ Can you apply under the Parent route instead of the Partner route?

According to the UK Immigration Rules, you can apply under the Parent route if you are not eligible to apply under the Partner route （in cases where you also have a settled/british spouse).
Paragraph E-ECPT.2.3(b)(iii) of Appendix FM clearly states:

> “The applicant must not be eligible to apply as a partner in order to qualify under the parent route.”

This means that if you meet the requirements to apply as a partner(for example, you are married to or in a relationship with the child’s other parent and live with them), then you must apply under the Partner route.
You cannot choose to apply under the Parent route just because it seems easier or more suitable.

Theo Quy định Nhập cư của Vương quốc Anh, bạn chỉ được nộp đơn theo diện Cha/Mẹ nếu bạn không đủ điều kiện để nộp theo diện Vợ/Chồng hoặc Đối tác.
