The question before the Court of Appeal in this case was:

‘whether the drunk passenger should have his compensation reduced for contributory negligence because he should have appreciated the driver was too drunk to drive safely.’

The passenger’s argument was:

‘that he was too drunk to realise that the driver was too drunk to drive safely therefore that there should not be a reduction for contributory negligence.’

The Court of Appeal found that contributory negligence did apply and compensation was reduced by 20%. The test was whether a reasonable, prudent and competent man in the passenger’s position would have appreciated that the driver had drunk too much to drive safely.

We will never forget the year 2020 with the strict lockdowns brought in to reduce the spread of the Covid-19 pandemic.

There were fewer people on the roads of Great Britain. This led to a decrease of 22% in the number of people killed or seriously injured on our roads compared to the previous year.

You will be surprised to learn that during 2020 there were still 1460 reported road deaths which averages 4 per day.

No doubt the statistics for 2021 will show an increase in these numbers.

Please take extra care out there during these dark, cold winter months.

Fixed Recoverable Costs already apply to personal injury cases up to a value of £25,000.

The government has now announced that Fixed Recoverable Costs will be introduced for most civil cases worth up to £25,000.

Further, the government will also expand the fast track to include simple ‘intermediate’ cases valued between £25,000 and £100,000 in damages.

The introduction of Fixed Recoverable Costs has had an impact on solicitors representing claimants in personal injury claims, however, we at Personal Injury Pal continue to take on cases aiming to recover compensation for those injured in accidents.
