What a great week: 2 complex legal PIP hearings, both succeeding on points of law rather than going through the upset of a full hearing. The law is your friend - if you know how to use it - most reps have not got a clue - we do, we are uniquely qualified and experienced to help you!

If a Tribunal can find in the Appellant's favour on a point of law (that is they do not need facts), should they adjourn because the interpreter has not turned up - or just award? Get on with dispensing justice I say!😇

Outrageous case today, the DWP should be ashamed. Our client had chronic deep rooted mental health difficulties. The Tribunal awarded benefits in 2014 and again in 2018, but refused her in 2017. The Judge said there was clearly no change between those dates. Our job was to make it as easy as possible for her to go to the Tribunal, and make the hearing as easy as possible with strong written submissions.

There a 3 main things you need to prove to the Tribunal to have them determine a case in your favour? 1 - medical evidence, 2 - evidence of assistance received (or ought to receive), 3 - What else do you think?

So last week the Judge was unwell, this week a different Judge is stuck on the M42 with a flat tyre! See they are human after all!

Ooooh, frustrating case today. Client was clearly confused, but gave evidence that he had not eaten anything at all, or drank anything for a 2 month period!! There is nothing more important before the Tribunal than being credible, after all, you are giving evidence and it needs to make sense. Need help? give us a call.

Awkward case yesterday; our client is erratic with serious Mental Health (M/H) issues - we got a Judge who doesn't seem to appreciate M/H. FtT had clearly not read our in-depth written submissions; so, if our client doesn't win we will have to go to the Upper Tribunal! It is unacceptable for a FtT to not listen carefully to a qualified, experienced representative and to then question the Appellant before reading submissions - that is the tail wagging the dog!
