When does a GP mistake become medical negligence?

Not every medical mistake will be considered negligent. However, where a GP's care falls below an acceptable standard and causes avoidable harm, there may be grounds for a medical negligence claim.

Our Head of Medical Negligence, Neil Clayton, examines the legal tests used to assess GP negligence, explores common examples of negligent care, and outlines the steps involved in pursuing a claim.

When we seek medical treatment, we place our trust in healthcare professionals to provide safe and effective care. Most of the time, that trust is well placed. However, there are occasions when serious mistakes occur that should have been entirely preventable.

These incidents are known as "never events". NHS England's provisional data shows that 274 Never Events were reported between April and November 2025 alone, including wrong-site surgery, retained foreign objects after procedures, and wrong implants or prostheses.

The consequences can be devastating, leaving patients and their families facing physical injury, emotional trauma, financial hardship, and a loss of confidence in the healthcare system.

In her latest blog, Medical Negligence specialist Tara Pooni explores what never events are, the legal rights available to those affected, and how specialist legal support can help individuals seek answers, accountability, and compensation following a serious medical error.

If you or a loved one has been affected by a Never Event, understanding your legal options is an important first step towards getting answers, accountability, and support.

Equal pay remains a key consideration for employers committed to building fair, compliant and inclusive workplaces.

Under the Equality Act 2010, organisations must ensure employees receive equal pay for equal work, whether that work is classified as 'like work', 'work rated as equivalent', or 'work of equal value'.

Understanding equal pay obligations is not only about legal compliance. It is also about strengthening employee trust, protecting employer reputation, and supporting a positive workplace culture.

Marked each year on 27th July, World Head and Neck Cancer Day raises awareness of certain cancers, and how early and accurate diagnoses are crucial. This is largely because symptoms can often resemble common, non-serious conditions such as a sore throat, cold, dental problem or infection.

Neelam Y. explains more in her recent article, including symptoms to look for and what the consequences are if diagnosis is misinterpreted or delayed.

We're really proud to be part of the The Katie Piper Foundation legal panel, supporting burn injury survivors access the rehabilitation and legal support they need throughout their recovery journey.

We’re pleased to be relaunching the Katie Piper Foundation Legal Panel.

After a burn injury, there can be so many unknowns – and for some people, that includes whether they might need legal advice. It’s not something anyone expects to navigate, and it can feel overwhelming at an already difficult time.

Our Legal Panel exists to make that step feel clearer and more supportive. If someone does need legal guidance, we want them to be able to access people we trust – who will treat them with care, fairness and respect.

We’ve partnered with three firms who share these values: Boyes Turner, Lime Solicitors, and HCC Solicitors.

Each firm takes a thoughtful, client-centred approach and understands the importance of rehabilitation alongside any legal process. They also work on a no win, no fee basis where survivors keep 100% of their compensation.

This isn’t about encouraging people to take legal action. It’s about making sure that if someone does need advice, they don’t have to face it alone or navigate it without support.

You can find out more about how the panel works via our website.

When early warning signs are missed, the consequences can be life-changing.

Michael contacted his GP with severe pain and worsening symptoms, but the seriousness of his condition wasn’t recognised in time. By the time he was admitted to hospital, he was critically unwell with a rapidly progressing infection. Tragically, this led to a below-knee amputation and long-term impact on his life.

Ikhira Thandi, who represented Michael, says: "This was a serious case involving a rapidly progressing infection that led to permanent and life-altering injuries.... We were able to support Michael through this process and secure a settlement that reflects the impact of what happened to him.”
