It is well known that the UK population is ageing, with more people living longer lives than previously, and the most recent data shows that nearly half a million people live in care homes in the UK.🏡

Under the Care Act 2014, if a person is taken into care, the Local Authority can use the value of the home owned by that person to fund their care. This could ultimately mean that when the person dies, there is very little of their estate left to be given to their family. It is illegal to deliberately avoid paying care fees by giving your property away, however it is permissible for both spouses to make a provision in their Will to “sever the tenancy” and allow each spouse to put their half of the property into a Property Protection Trust for their intended beneficiary(ies).

According to insurer Royal London, two in five homeowners do not have a will, meaning that their property could pass to the wrong person when they die. 😔

It's even more critical for cohabiting couples to have wills than married people or those in civil partnerships. That's because the surviving partner has no automatic rights to inherit under the intestacy rules if you're not married. In these cases, any children you have will inherit the estate.

Unfortunately, if you plan to pass on assets or money after you die, your heirs could face a tax bill of up to 40% of your estate through , and this isn't something that can be rectified once you've passed.

Throughout life, individuals often support charities close to their hearts, furthering their support for the charity upon their death by including them as a beneficiary in their Will. The money that is left to charities in Wills is often the much-needed financial income needed to keep charities afloat.
