What happens if I don’t make an LPA?

If you don’t make an LPA, and later become unable to make certain decisions for yourself, there be a time when no one can legally make decisions for you, or pay your bills.

If this happens, someone will likely apply to the Court of Protection to become your Deputy. A relative or friend can apply to be your Deputy, or a professional may be appointed. The application process to become a Deputy is a lot longer and can take many months and is more expensive than having an LPA.

Act now, as an LPA will save your family the heart ache and stress of making a Deputyship application.

What is an LPA?
A Lasting Power of Attorney (LPA) is a legal document which allows the person of your choice the power to manage your financial affairs and/or medical and welfare decisions in the event of mental incapacity, and therefore does not become invalid on mental incapacity.

A Deputyship Order is a legal document which enables an authorised person to deal with the financial affairs of someone who has lost mental capacity. A Deputyship Order is needed when the individual concerned does not have a Lasting Power of Attorney (LPA).
