I’m often asked the difference between a Basic Will and a Trust Will. Infact it’s the number one question I am asked by my clients.
A basic will is often the right choice if:
• Your family and personal circumstances are straightforward
• You are married or in a civil partnership with no complex arrangements
• You are happy for beneficiaries to inherit their share outright
• Your estate is very modest in value
• You do not need to control how money is used after death
• You want a simple, low-cost solution
• You mainly want to ensure assets pass smoothly to loved ones
When a trust will may be more appropriate:
A trust will is often worth considering if:
• You have young children and want to delay when they inherit
• You want to protect children’s inheritance from a previous relationship
• You are in a second marriage or blended family
• One or more beneficiaries may struggle to manage money, they may be vulnerable, have extra needs or even have addiction problems and you want to safeguard them.
• You want to protect assets from divorce, creditors, or future risks such as sideways inheritance which is unfortunately quite common
• Your estate is larger and inheritance tax planning is a concern
• You want control over how, when, and for what purpose assets are used
• You want long-term protection for vulnerable beneficiaries. This may include children with extra needs, those with mental health difficulties or even addiction issues.
