Why reviewing your Will every 5–10 years is one of the smartest things you can do…

In the UK, reviewing your Will every 5–10 years is a sensible rule of thumb because both life and the law rarely stay still for long.

1) Life changes quietly… then suddenly

A decade can bring major shifts:
• Marriage , separation or divorce (marriage revokes an existing will in England & Wales)
• Children or Grandchildren come along
• Death or estrangement of beneficiaries or executors
• Blended or step-families
• Loved ones with additional needs who may benefit from a Trust
Will.
If your will doesn’t reflect your current reality, it may not do what you expect or need.

2) Your assets evolve

Over time you may:
• Buy or sell property
• Start or close a business
• Build pensions, investments, or crypto
• Change ownership structures

Older Wills often miss newer assets, leading to delays or unintended outcomes.

3) Tax rules change

IHT rules and reliefs shift over time:
• Nil-rate bands
• Residence nil-rate band
• Gift and trust rules

An old Will can quietly become tax-inefficient.

4) Legal wording evolves

Best practice moves on:
• Trust clauses
• Executor powers
• Digital-asset provisions
Modern wording reduces ambiguity and disputes.

5) Executors and Guardians age too

Circumstances change. The right person 10 years ago may not be the right person today.

A reviewed Will:

• Keeps wishes clear and gives you added peace of mind.

Bottom line:
You may not need a new Will — but you should review it. Think of it as an MOT for your Estate Planning.

Afternoon everyone. Thanks for the follow. I’ve had a busy week. I’ve had many of you getting touch regarding updating your will due to Family dynamics changing. I often say that everyone should keep their wills up to date. You may want to include Grandchildren or update the guardians of your children if both you and your partner were to pass. Your personal circumstances tend to change over the years,so it’s worth checking that your Will and the people mentioned in it are updated to reflect this.

I’m often asked the difference between a Basic Will and a Trust Will. Infact it’s the number one question I am asked by my clients.

A basic will is often the right choice if:
• Your family and personal circumstances are straightforward
• You are married or in a civil partnership with no complex arrangements
• You are happy for beneficiaries to inherit their share outright
• Your estate is very modest in value
• You do not need to control how money is used after death
• You want a simple, low-cost solution
• You mainly want to ensure assets pass smoothly to loved ones

When a trust will may be more appropriate:

A trust will is often worth considering if:
• You have young children and want to delay when they inherit
• You want to protect children’s inheritance from a previous relationship
• You are in a second marriage or blended family
• One or more beneficiaries may struggle to manage money, they may be vulnerable, have extra needs or even have addiction problems and you want to safeguard them.
• You want to protect assets from divorce, creditors, or future risks such as sideways inheritance which is unfortunately quite common
• Your estate is larger and inheritance tax planning is a concern
• You want control over how, when, and for what purpose assets are used
• You want long-term protection for vulnerable beneficiaries. This may include children with extra needs, those with mental health difficulties or even addiction issues.
