Here is our Pre-Sale Check List to avoid experiencing delays further down the line.
𝐓𝐈𝐓𝐋𝐄 𝐃𝐄𝐄𝐃𝐒 - these prove that you are the rightful owner. Perhaps these are with your mortgage company or a former solicitor. If so, these can take weeks to be released.
𝐓𝐈𝐓𝐋𝐄 𝐌𝐀𝐏𝐒 - Do you own everything that you are trying to sell?
𝐏𝐋𝐀𝐍𝐍𝐈𝐍𝐆 𝐏𝐄𝐑𝐌𝐈𝐒𝐒𝐈𝐎𝐍 & 𝐁𝐔𝐈𝐋𝐃𝐈𝐍𝐆 𝐂𝐎𝐍𝐓𝐑𝐎𝐋 𝐂𝐄𝐑𝐓𝐈𝐅𝐈𝐂𝐀𝐓𝐄𝐒 - if you've made extensions or alterations to your property, or had a new boiler or stove installed, you'll need to provide copies of the planning permission and Building Regulation approvals.
𝐌𝐀𝐍𝐀𝐆𝐄𝐌𝐄𝐍𝐓 𝐂𝐎𝐌𝐏𝐀𝐍𝐈𝐄𝐒 - if the property you are selling is part of a managed development, you will be required to obtain a Management Pack from the management company and disclose all additional fees to interested buyers. At LMK Law, we will also need to ensure that the Management Company actually owns the Common Areas and has submitted appropriate returns to Companies House.
𝐄𝐍𝐄𝐑𝐆𝐘 𝐏𝐄𝐑𝐅𝐎𝐑𝐌𝐀𝐍𝐂𝐄 𝐂𝐄𝐑𝐓𝐈𝐅𝐈𝐂𝐀𝐓𝐄 (𝐄𝐏𝐂) - if your home does not have one, you are legally obliged to get one before selling.
𝐒𝐄𝐑𝐕𝐈𝐂𝐄𝐒 - Do you have the appropriate rights to bring services to your property; water, BT, electricity, or run a sewer from your property? If you need to obtain legal rights over neighbouring properties, these need to be resolved before you go to the market.
All the above can impact the Sale process, causing delays and making the buyer look elsewhere.
